Don't want my kids issued Indian Entry Visas.... HELP

My x husband is of indian origin, but a naturalized US citizen. I am not of Indian origin and a born US citizen with no passport. My children are suppose to travel to India in November, but I have not signed for their visas. I want my children to be given Tourist Visas NOT Entry Visas, but their father is saying that since he is of Indian origin, they HAVE to be issued Entry visas.

1. Is this true?

2. What are the differences and benefits between Entry Visas and Tourist Visas?

3. Can you get an OCI card if you have a tourist visa?

I need this information ASAP because I will be going to court in a few days.

If a parent is of Indian origin, then the spouse and kids are supposed to get Entry visa and not tourist visa anymore according to the rule from June. Technically, I don't understand why they started this new rule. May be they want spouse/children to get PIO or OCI cards. I don't know whether you can get OCI from tourist visa. 05/06/09 - Mailed I-751

05/15/09 - Check cashed by VSC

05/18/09 - Received I-751 Receipt Notice

05/30/09 - Received Biometric appointment for 06/08 (dated 05/22)

06/08/09 - Completed biometrics. Still unable to access case status online. Now the real wait begins!

06/09/09 - Finally case status showed up online!. Touched today

09/21/09 - Approved (Letter from USCIS Vermont, dated 09/16/09)

09/23/09 - Card production ordered

09/30/09 - Card received!. USCIS done until citizenship!

05/21/10 - Mailed N-400

05/24/10 - N-400 received at Dallas, TX Lockbox

06/01/10 - Check cashed

06/04/10 - Received N-400 receipt notice (NOA dated 05/27)

06/29/10 - Placed service request for not receiving biometrics. Transferred to immigration officer, who confirmed that the Biometrics

letter has been generated and I would be receiving it shortly.

07/01/10 - Email and SMS case update stating that the Biometrics letter has been sent on June 29'th 2010.

07/06/10 - Received Biometric appointment for 07/23 (dated 06/30)- DONE

08/02/10 - Received yellow letter reminding me to bring my state ID (dated 07/28)

08/05/10 - Case touched. Email and SMS case update stating that the case has been transferred to the local office for interview.

08/06/10 - Case touched

08/06/10 - Received interview appointment for 09/10 at 9:20AM in Philadelphia, PA

08/07/10 - Case touched

08/10/10 - Case touched

09/10/10 - Interview completed and recommended for approval

09/17/10 - Oath ceremony scheduled for Sep 29!.

09/29/10 - Oath completed. US citizen as of today. Journey complete!.

I think with an Entry Visa your kids would need to be registered at the local FFRO if staying more than 14 days.

There are many restrictions on the Tourist Visas that hadn't been there before including not being able to re-enter India within a 90 day window from leaving - for eaxmple, if you entered India on May 1st and left May 3rd you would not be permited to re-enter India again [without special permission, a special visa endorsement and by registering at an FRRO office] until September...This is all fallout from the terrorism issues. It's been a nightmare for a lot of people using DEL airport because Indian border agents were not letting people get connecting flights had they gone thru Indian border control for a long lay over or as part of an intenarary that had stops in India intermixed with other countries [especially Nepal]. Supposedly, the layover/connecting flight issue thing has been fixed - as well as the tourists doing 3 days here, 2 days there, 3 days here type tour packages in South Asia that fly from BOM or DEL.

By getting the Entry Visa I guess the thought is fairly simple - those with direct ties to India will not need to go thru the 90 day restriction period. I can imagine India's consulates and embassies around the world do not want to continually need to offer special endorsements to spouses/kids/grandkids who may need to visit more frequently for family reasons.

In your specific case - I read some of the other threads you've had - I COMPLETELY understand why you want them to have tourist visas. I'm not sure if having merely a tourist visa would stop any nightmare situations from happening given money talks in India when something needs to be fixed...a tourist visa could magically turn into a PIO under the right scenarios/connections, if you know what I mean.

As the minor children on an OCI card holder they are also eligible to become OCI card holders themselves. Their father could apply at the Home Ministry for their OCI cards or PIO cards after reaching India. It doesn't matter what visa they go on.

THanks to everyone responding. I know type of visa really does not matter if he decides to abduct our kids, however, if he does, they will be able to put more charges against him in the us because there were specific court orders stating he was to get tourist visas, no pio, or Oci cards for our kids. I have a hearing Monday for contempt charges so we'll see what happens. But thank you to everyone that responded.
