Thank you again, do you think if i try to call and explain they might help? or i have no choice but to get the new one?

Never listen to Tier1 person. Ask him to transfer to his/her supervisor (Tier2) and explain it.

Sometimes, Tier1 will not pass to Tier2. But, somehow you will have to overcome it, by treating it as RFE and urgent matter.

It is not a big issue, Newbie.

Some more time is lost in this frustrating process.

Do you have like a government head office that handles all the marriage registrations? From what I understood, the USCIS wants the marriage to be recorded to the higher state. I don't know about Nepal but here in my case, we have our marriage registered in the local civil registrar of our city then we submitted the paper to the national statistics office. After two weeks, I obtained our marriage certificate in security paper. Therefore, our marriage is already registered in the national database.

Do you think a letter from Consulate General clarifying or maybe translating of the existing one would be valid? I spoke to the Tier 2 today and explained the situation. They told me to just send a letter with RFE Explaining the situation..But i don't want to take a chance....seems like the Tier 2 didn't have much information for me either...

I read this from the Embassy of Nepal website in DC and they mentioned an original birth certificate and this:

Copy of letter issued by Registration Office in Nepal (Registration Section of the Ministry of Local Development or Village Development Committee or Municipality certifying applicant's birth.)

Maybe your wife can go to the Registrar Office and have that letter so you can send it and that would be your evidence :)

I just called Embassy of Nepal and you are right, she needs to actually get a copy of registration in Nepalese language and certify by Registrar's office..man this is going to delay things more.....

How does the RFE works? Do they send multiple RFE's as they review the application? or they review the application first and then send out the RFE at once.. I am just worried if i will be seeing more of these for other documents..

I'm sorry but it looks like it. But don't be too frustrated. Focus on the main issue and that is to get that certified letter ASAP. Maybe you can ask the Registrar's Office if you can request for it using "electronic endorsement". I don't know if they have it there but just try. It would be the quickest way to get the document. Then use a courier to send it, that way it will be faster and you can track it.

RFE's are documents that further define or clear out any discrepancy with the document/s you submitted. The number of RFE's will depend on how many documents that needs to be clarified. As for now, try to get what they asked from you. Hopefully there'd be nothing else. Oh and if possible keep a personal copy of every document you submitted or you're going to submit.

Also, get 2 copies of the new marriage certificate (original) - one to USCIS and one to NVC.

USCIS "in this case" will return your original because it is RFE response. But to be safer, get 2 of them.
