First, I noticed that this form is not referenced in your list of forms to submit when applying for AOS.

It looks like this forum is geared more towards K-Visa holders, for whom this form may not be required.

I am a former H-1B and now an E-holder through my company but now I am applying for AOS since I married a US citizen.

My husband needs to complete I-130, Petition for Alien Relative, and I have the following questions:

I-130 – Item 19 – do I need to provide an address abroad or can I leave this blank? I have been living in the US for many years and don’t really have an address in Germany anymore other than my mother's.

Same form, item 22 – on the consulate abroad – can I leave this blank since I am eligible for AOS? I am just concerned they send me to Frankfurt for some reason if I put Frankfurt, Germany there.

The address abroad questions resurfaces on G-325A where they ask me again for an address abroad for more than one year. I don’t want to confuse them by adding an address that coincides in time with me living in the US. But then, I understand that I am considered a non-immigrant and should have an address abroad.

What is recommended? I can add an address but what time frame should I use when I lived there?

Thanks for the help.

You may be a non-immigrant but you have a visa and are legally working and therefore living in the US. So I would say put your current actual address and on the G-325a put the address at which you last actually lived abroad. For Item 22 you can fill in the entire section: it is quite clear that you are applying for adjustment of status and they won't somehow transfer you to the IR1 pile! For item 19 I am not sure if you must provide a foreign address or not. But it will be clear from both the G-325a and the first part of section C on the I-130 that your main/current address is the US one, so don't worry about it confusing them if you do put your mother's address here.

Thanks.

Do you think it matters if the timeline of an address in my home country overlaps with a time I was already in the US?

Just not sure, I have been here since 1997 on different visas.

Hey I was in a similar situation.

I spoke to someone from INS and he advised to ONLY put your current address on the I-130, put N/A in the address abroad section. Equally, put down your LOCAL office (ie not Chicago lockbox) in section 21, and leave section 22 blank.

Thanks.
