filing I 751 HELP pls!!!!!

conditional card will expire on dec. 3 2010. We cant afford to pay our lawyer to file this for us. I have no idea how to do this. please help me how and where to start. I'm on maternity leave right now for preterm labor, so I'm thinking maybe i can start this. anyone please. for starter, i Printed out the form for I 751 @ kinkos yesterday. I Apologize in advance for this. I just dont want to mess this up. We're expecting our first baby this nov. and im afraid i wont be able to do this right. thank you!!!!

First off, breathe!

Second, since you have the form already printed off, start filling it out.

What you need to include with the form:

-copy of both the front and back of your green card

-evidence of the relationship (this can include lease/mortgage in both your names, joint financial accounts, pictures, affidavits, etc)

If you've ever been arrested, you're going to need to include statements and criminal records and such.

You also need to include a check of $545 for the filing and biometric fee.

And then mail it all off.

Two more things to read to help you: The guides for removing conditions (see the "guides" link at the top of Visa Journey) and Gary and Alla's thread pinned at the top of this section. Obviously, the instructions for the form as well. That should give you a pretty good idea of what you need.

Relax---most of us have done this without hiring an attorney and had no problems.

Thank you for the reply. I printeD the instructions on how to file it from this website and one from the uscis web.have a lot of questions though

1. Do I need to have 2 PASSPORT photos?

2. Do I have to have the fingerprint card?

3. Do I file all the paperworks in a folder?

4. Are these evidence enough?

a. i do have our apt lease for the past year and current one.

b. 2 joint checking accounts

c. 2 savings account

d. 2 credit cards

e. a vehicle loan together

f. car insurance

g. one car title both of us own it.

h. life insurance

i. tax returns for the past 2years.

5. Do I need to send a copy of my passport?

No, you do not need to send passport pictures. They're not needed with this form.

No copies of your passport are needed for this either.

The evidence you listed looks great. I doubt you'd have any problems with all that evidence. You don't need any affidavits since your evidence looks sufficient enough. If you do decide for affidavits, you need a minimum of two. In the instructions, it gives a long paragraph on what's needed from an affidavit.

Hi to everybody.:D

just like Xxochil18 and sonoransongbird, My husband and I will apply for I-751. My card will expire on Jan.29, 2011 so my window opens on Oct.31 But that is a Sunday so we will file on Nov.1, which I think is ok. right? But I am getting crazy as heck as to what evidences we can give. xochitl18, I am also having the same problems, I have been stressing over this for over a month now and since I don't have a job right now, I get stressed even more. The job hunting is stressful enough. And we can't afford to have our lawyer file this for us either..

Here is what we have as evidences:

  • 401K- he had me as beneficiary
  • health insurance
  • 2 credit cards --(which we already gave to them initially as one of our evidences)
  • 2 credit cards --he recently added me on the other one as of Oct.14.
  • Title of one car we both own (his dad's old truck that he was actually using, but his dad decided to give it to us)
  • car registration with both our names
  • Leases of our apartment for last year and current
  • 3 utility bills ( all of our bills are addressed to both our names)
  • 2 checking accounts
  • 2 savings accounts
    -the first checking and savings accounts were also part of the initial evidences
  • USPS notices stating that we changed addresses ( I kindof included this just to indicate that we have the same address)
  • pictures
  • cards addressed to us???

We don't have life insurance and car insurance. I just got my license last august and I don't have my name on the insurance because his dad just renewed it this year, I think like a couple of months ago. He still drives it every now and then and we drive his car. We are looking into it if he can add me on the insurance. We are planning on buying a car, but then since I don't have a job, we have been kinda picky. We are planing to have kids next year too...

Do you think these evidences are enough? I am kinda worried that since we don't have life and car insurance together, we don't have two cars and we don't have kids yet, we lack evidence. And if they can't include me in the insurance thing.

For the credit cards do we need to include statements? or just the cards will do?

Do you think filing days after the 90 day window opens will have an effect on our case?

Do you think we need affidavits? They can be NOT notarized, right?

I am so worried and stressed...:( thanks for all the help in advance..:) I apologize for so many questions...

Your evidence sounds like it will be enough. Shows joint address and joint ownership of at least one asset, so you should be good.

Re affidavits: This is a question I have as well. We were not going to include any just because I don't want to bother any of our friends with it. But the way the instructions form is worded, it sounds like it is mandatory---even though it isn't really as important or telling as joint assets and so on. (According to Gary and Alla's post, Chat with USCIS Director, it's helpful but not as important to them---and doh, isn't it obvious you are only going to ask friends who you know are going to say you have a good relationship?)

Re car insurance: For ROC purposes, I wouldn't worry about it. You have lots of other things that prove essentially the same thing.

Re credit cards: Personally I would include statements rather than the cards themselves just because it probably is going to photocopy better. You can also cross out the account numbers. Not sure there really is a right answer on that one though.

I recall one filer that sent their evidence in a binder but I would skip it, they will most likely remove everything anyway. I am using tabs to mark each section and clips. The idea is to make it as easy for them to access your information as possible.

A cover letter is a good idea to explain anything you think might not be clear from your evidence. For example our house deed and utilities are in my husband's name only as he simply transferred everything from the residence he owned prior to our marriage. I will explain that in our letter.

I believe the fee is still $545 ($465 I-751 + $80 biometric fee), increases do not take effecet until November 23. 2010

Thank you sonoransongbird and OBX for your replies. I really appreciate it. We are still not done with our pictures. We have to go over them again, there are a lot.:)

To xochitl18, I agree with OBX. I think you can just fasten it and put tabs on each section. Thant was a good idea OBX :thumbs:

The cover letter is also helpful so that you can also list all the evidences you put so that they will have a guide while they are going over it.

I do think that it would be at the Laguna Nigel office but I am not really sure..:D Good luck to you!:D

Did anybody else receive a reminder letter from USCIS? I got mine at the start of October, saying that I need to file the petition to remove the conditions. I actually panicked and started counting 90 days and the window opens on Oct.31. It is ok to file within the window right?

Anyway, so my husband and I are going to print out statements and other stuff. Did you guys print two years worth of statements or did you just print an average of two statements? Like for the Bank Accounts and Credit Card Accounts.:)We were at the bank the other day and asked for a letter of Deposit or something and they said they can only give us one. I asked if he can give us a letter for all the accounts but he said they can't.

We are still thinking if we need to have affidavits. i don't think that any of our friends will be comfortable with putting their SS numbers in the letter then having the trouble of having them notarized. Can they not notarize them at all?

I hope it goes well for all of us. :)
