Timeline

Hi, all.

I have two questions:

1. My GC will be expiring on February 10th 2011. We plan to send the ROC package a few days after November 10th 2010. Would that be considered too early?

2. I went on the USCIS website to look at the I-751 instructions and application form. It says that the fee is $545 (which includes the bio fee). I saw somewhere in this forum that the fee is supposed to go up to $590 (#######?!) on November 23rd 2010. Is that true? I saw no evidence on the USCIS website stating the fee change. If it turns out to be correct, would the cheque for $545 be accepted if they receive the package before that date?

Hi,

The earliest you can apply is 11/22/2010 and not 11/20. Remember it is 90 days and not 3 months. A day early means denial of application and they will simply send it back asking you to send it when you are within the 90 days.

As long as the fee change is not officially on the USCIS website, then I wouldn't care what other sites say.

1 - Yes, it's too early. It's not three months, but 90 days in advance. If I counted probably, the earliest you can send it in is November 13th, on a Saturday.

2 - And yes, it's true. A lot of fees are going up on November 23rd. I would suggest mailing out the application the week of the 15th and you should be fine.
