#22 on the I-130 Form

Basic info: I am US citizen, husband is in Canada while we apply for his VISA.

Question #22 on the I-130 Form asks:

22. Complete the information below if your relative is in the United States and will apply for adjustment of Status (my husband is NOT in the US):

a.Your relative is in the United States and will apply for AOS to that of a lawful permanent resident at the USCIS office in: ______________________ (obviously we do not meet this requirement)

b. But the it says: If your relative is not eligible for AOS, he or she will apply for a visa abroad at the American consular post in: ________________________

My question is.... if the original question in BOLD does not apply to us, do we have to answer the second part? How do we need what the post is if we DO need to? This is confusing to me.

Since your beneficiary isn't in America, you will put n/a on 22.a. You will also put n/a on 22.b since your beneficiary isn't filling at a embassy or consulate. You are, as petitioner, filling it with USCIS in America from what I understand.

That's kind of what I was gathering as well, but I wasn't sure. Thank you! Sometimes on the examples, I can't tell their "fake" situation in order to compare to ours. There was something in that field for the example, but it didn't seem to make sense from what I was reading elsewhere.

People become over-analytical when filling out these immigration forms. They don't want to make any mistake with what could potentially effect their entire life. Sometimes you just want to throw your arms in the air... like you just don't care...

A general rule of thumb is to never leave any field blank. Just n/a the bejesus out of the forms; so, later noone will come to you asking for more information because you left a non-applicable field as blank.

I actually left that section blank since I figured it didn't apply to our situation... ...not a recommended method but that was prior to discovering VJ. Luckily it didn't cause any problems, I was approved without any issues.

I later discovered that many fellow filers but n/a for part (a) then Montreal, Canada for part (b) but I still think n/a for both would be more appropriate considering how the initial question is worded.

As IndigoSkies posted the key is not to leave anything blank.

It is advisable to write N/A in22A and the Consulate city and country in 22B.
