USCIS incompetance!

Timeline

Well a bit of a rant here, but I will start with some background:

Came into america on K-1 (had my medical in england)

Submitted AOS

Got RFE during acceptance stage due to medical mistake (hadn't been signed by a civil surgeon in america)

Waited 4 months

Got RFE saying "We can't find your medical forms from england, redo them"

So I rang USCIS, got posted to 2nd line, who said basically "yeh, our bad, we lost them, but you still need to pay to get them done again"

ARGH!!

Did you get your RFE today? It just sucks that after waiting for 4 whole months, you get a letter saying: "Oh, we need this from you!"

Yep, got RFE letter today, for them losing forms. To add insult to injury, I already forked up $160 to the civil surgeon due to the first RFE.

This is sheer incompetance on their part, I am really sorry! Also, I fail to understand the significance of applying early for AOS. I mean I am really happy for all my fellow VJ'ers who have been approved but why are the people who have applied in May-June put on the backseat?

I fail to understand how this system works!

Ok so, update.

I rang back and got through to the most senior person I could, who is investigating for me and talking to her supervisor about what is going on with my case and specifically what is going on.

I am basically pushing for USCIS to foot the bill for the medical if they are the ones who have lost it (though I am not holding my breath on this)

Coming from the U.K., it's perfectly understandable that you're having a hard time coping with the screaming incompetence in the US. It was, and still is, the hardest thing for me to adjust to. The US is a country full of incompetent people. Be advised that those with complete brain removal work either at the SSA or the DMV.

If it doesn't come back favorable, raise hell with your congressperson/senator. They have access to much more responsive customer service, AND those people actually look at your physical file and seem to know what they are doing.

January 22, 2010: Bogus RFE corrected through congressional inquiry "EAD waiting on biometrics only" Read about it here.

March 27, 2010: Green Card recieved

ROC:

March 1, 2012: Mailed ROC package

March 7, 2012: Tracking says "notice left"...after a phone call to post office.

still waiting for call back, if it gets to one hour before the end of the officers shift I plan to call back and chase, as I have the medical scheduled for tomorrow morning (something I would rather not do and pay the money for without needing to).

Unfortunately they only gave me a month (lol) to submit my information for this, so raising hell really isnt going to be in my best interests due to time constraints, especially if I have to redo tb skin tests which take a week.

have you tried contacting the doc that did your medical in the UK? I had mine from Aus forward me another copy of the medical in case this happened to me.

Well the person who was meant to call me back had gone home. The Officer I spoke to suggested I prospone my medical (the 3rd one) and her supervisor was going to talk to the adjudicator tomorrow morning and get back to me first thing. I won't hold my breath but I imagine another day on hold to USCIS to come.

On the up side they did say if it was their error, they would front the cost of the new medical, so just a case of them investigating it internally before my deadline for reply runs out.

Well that's great!

But you could also in the meanwhile try to contact your UK physician too.He might have saved a copy of your medical record.
