I'm About To File IR-1 / CR-1

Hello Everyone,

I am about to send our completed I-130 in and just wanted to double check, if there's anyone out there, if I am doing this correctly. I am trying to avoid hiring a lawyer because of financial restraints - so if anyone has gone through this, your assistance would be greatly appreciated.

Back Story: I met my husband online and we got married on Sept 24, 2010. I am Canadian and he is American. Our plan is for me to remain in Canada while everything is being processed/approved *knock on wood*. Our end goal is for me to move to Kentucky to be with him and be able to work ASAP.

Questions:

1. We've opted to file the IR-1/CR-1 as opposed to the K3 Visa. Is this right?

2. I have completed the I-130 petition package as outline Here. At this stage, is there anything else I need to do, other than wait for the NOA?

3. I printed off the I-130 application from the USCIS website. It is only 2 pages, is this correct?

4. I printed off the G-325A applications from the USCIS website. It is only 1 page with a secondary "What is the purpose of this form' page. Is this correct?

I ask because I've read where people have said there are four pages and I can't find anything like that.

I truly appreciate any assistance!

1. Since you are married, you can only file I130 IR1/CR1. You made the right choice.

2. Seems all right.

3. Yes. I130 is only 2 pages.

4. G325A used to be 4 pages. But it's one page now. You're fine.

Wait... you said you are the Canadian citizen, right??? THE I-130 FORM IS FILLED OUT BY THE PETITIONER, meaning THE US CITIZEN!!!

This is the content of our packages:

1.Form I-130

2.Color photocopy of petitioners birth certificate, front and back

3.Color photocopy of petitioners entire U.S. passport

4.Color photocopy of beneficiary’s entire passport

5.Color photocopy of officially translated and notarized marriage certificate

6.Petitioners complete form G-325A, with photograph

7.Beneficiary’s complete form G-325A, with photograph

8.Notarized affidavits sworn to or affirmed by third parties

9.Photographs of our consummated marriage and ceremonies, dated with descriptions

Numbers 2, 3, 4, and 5 are unaltered photocopies of the original documents. Numbers 1, 6, 7, 8, and 9 are original documents.

Yeah, My husband is filling everything out. I'm just preparing as much of it for him as I can because.. well.. he's a man! lol

I'm doing my bit here and sending it down for him to complete and send off to Chicago! And thanks for your list. Does my husband need his Birth Certificate AND passport or just one?

I've sent plane tickets, itenaries, photos (both wedding and us with family members), emails/letters, birthday cards, affidavits (3), receipts from things we did together and ummmm.... phone records.

Do you think that's sufficient?

That should be more than enough.

I only sent in 3 notarized affidavits from family and friends in addition to the required marriage certificate. The reminder of evidence (spanning 10 years) was saved for our interview (none of which they looked at btw but better safe than sorry.)

I am another person who sends bare min. documents that are absolutely required.

Having said this, it all depends on the country where the applicant is from and other factors as well. So, including more secondary evidences is totally up to the satisfaction of the filer.

Good point Loto! Canada is not a high fraud country and most filers are fine with a minimum of evidence at the I-130 petition phase. However, you need to be comfortable with your submission regardless of what others have done.
