When to File I-751?

Ok, I read on here that you're supposed to file 90 days before your conditional green card expires (just like it says on the form) but I know that when I talked to the USCIS after my wife received her conditional green card in March of 2004 that they said to file 6 months in advance instead of the 3 months as directed on the form because of the backlog of applications. So which should we believe? We can't afford to throw away $205 like one post said you'd be doing if you filed too early but if we indeed should file 6 months in advance that would mean we'd be filing in the middle of this September.

Another question we have is on the two (or more) sworn affidavits from people who have known us since my wife received her conditional residency, can those be from relatives (Mother, Uncle, Aunt, Cousin etc.) or should they be from non-relatives (friends etc.) or one from both?

K1 Process

6-28-2004 Submitted I-129F Petition for Alien Fiancee

7-9-2004 Received NOA1 (receipt notice)

7-28-2004 Received NOA2 (approval notice)

8-2-2004 Received NVC notice saying my petition was being processed and would be delivered to the US Embassy in Manila within a week.

8-16-2004 Called US Embassy in Manila to verify they had received my petition for my fiancee and inquire as to approx how long before she receives her K1 packet. Nice lady informed me they received my petition on July 30th and that my fiancee would be receiving her packet in about 1 week and that her K1 interview date at the embassy was October 22nd.

8-27-2004 My fiancee Ann received her K1 packet

9-16-2004 Sent my I-134 Affadavit of Support (and supporting documents/evidence) via FedEx to my fiancee. Was delayed 1 day because Mail Boxes Etc. didn't tell me I needed to declare a value for the photos I was sending as additional evidence.

9-28-2004 Ann's medical exam at St. Luke's (Day 1)

9-29-2004 Ann's medical exam at St. Luke's (Day 2)

10-19-2004 I fly back to the Philippines to attend Ann's K1 interview with her.

10-20-2004 I arrive in the Philippines

10-22-2004 Ann's K1 interview at the US Embassy...she's APPROVED!!!

10-30-2004 We arrive back in Vermont, USA to begin our new life together.

11-20-2004 We got MARRIED (reception on January 8th)!!!

AOS and EAD process

11-12-2004 Applied for Ann's SSN

11-22-2004 Received Ann's SSN

11-24-2004 Applied to change Ann's name on her SS card to her new married name.

11-30-2004 Sent Ann's completed Adjustment of Status and Employment Authorization documents to the Vermont Service Center via UPS (they received it on 12-01-2004).

12-04-2004 Received Ann's new SS card with her new married name on it.

12-09-2004 Ann's AOS and EAD packet was returned to us because we submitted it to the wrong place (Vermont Service Center).

12-13-2004 Resubmitted Ann's AOS and EAD packet to the correct place (the address of the Vermont Sub Office per the letter we received explaining why it had been returned the first time).

12-27-2004 Received NOA receipt forms for Ann's AOS and EAD.

12-30-2004 Got Ann's Biometrics and Fingerprinting done at the local sub office.

2-1-2005 Received Ann's EAD (Employment Authorization).

2-14-2005 Received NOA telling us Ann's interview for adjustment of status is scheduled for March 14th.

3-14-2005 Ann's Adjustment of Status interview at Vermont Sub-Office...she's APPROVED!!! Her Conditional Permanent Resident (green) card will arrive in 5 - 8 days.

3-21-2005 Received Ann's Conditional Permanent Resident (green) card and NOA welcoming her to the United States of America.

You can not file before Friday, December 15, 2006. if you do it will be denied.....

It is ok for you to have letters from family and friends.....

What if they file on December 15 and it is lost in transit? Can good cause be proven or do you have to refile? Will a postmark be acceptable and of course the cancelled checks? Apparently there is no kindhearted soul from DHS who is going to call and say you can file now your 90 days starts today.

What?

No, USCIS is not going to babysit you and remind you of your legal obligation.

People, it's not rocket surgery. You've got a 90 day period of time (not ONE day) to put a form and some evidence in the mail. It's the 90 days before your Green Card expires, as noted by the 'expires on' date on the face of the card.]

As always with USCIS mail, send it by some sort of trackable service so that you have a reciept of its delivery to the Service Center.

Then wait, and follow whichever set of instructions *you* get.

Logically, if the check is cancelled then the application was received, no? How could it then be lost in transit?

By the way, anyone been through this portion of the ordeal via the Vermont Service Center in Saint Albans? How long did it take? Was it faster than the other service centers? Any problems?

We've just filed through St Albans but who knows how it will compare 4 months down the line for you. This is probably the easiest part of the chain to complete so don't sweat the small stuff :thumbs:
