Hi,

A few questions...

My wife petitioned with an I-130 for her daughter (over 21, unmarried). We just got the Choice of Agent and AOS fee PDFs via email. Does this mean a visa # will be available by the time the app. process is finished? Our date is for mid-next year and I see from the bulletins that it's moving pretty fast. In any case it seems earlier than we expected.

Also, we have determined that our I-864 income won't be enough. My wife's daughter will use cash assets (5x the 125% Pov. level) instead. Can she use those exclusively? In what form do the assets have to be in and for how long? Can they be in a Chinese bank and in RMB? Do they have to be in U.S. dollars and in a U.S. bank? How long does the money have to have been in the account?

Lastly, is there a DOS/NVC web-page to check case status?

I have read some other posts which say that the immigrants assets can't be used alone. Is that right? We can get the amount required by asking many family members but if it's not a for-sure thing then we might try to get a joint sponsor.

Any ideas? How strict are they on the sponsor having income of some kind?

One of the things that the CO will will evaluate is how easily those assets (in this case cash) can be transferred to the US. If it isn't easy to take that amount of cash to the US it may not be allowed. Having the money in the US would make it simpler.

Thanks alot for the info. That makes sense. I guess we should start moving it over soon since one is limited on the amounts of transfer. Since we've already paid the I-864 fee then we will be filing that application soon right? I mean the cash will have to be over here and into an account soon so that they can see that (or do we have until the interview for that?).

One thing that worries me is that even after doing all of this (getting the assets together) that the CO may still deny it because my wife (the petitioner/sponsor) has no income. Though my wife had been working for the last three years she stopped working in May of 2010. I was laid of in March 2009 and am jobless now (I know that my unemployment benefits don't count). We have filed jointly for the last three years and had a good income but that is in the past.

So I think another question I have is, Can the income she received from January to March be considered income or is it just considered her assets?
