You have to be married to apply for the I130/k3 visa and whatever has you held in AP will still exist and hold you all over again. You must have a name hit that is being difficult to resolve. It won't be any easier married.

K-3 is a dead visa and only for a spouse, if you are currently married you do not qualify for a K-1 which will be a problem

Regardless, if you apply for another visa now, the same reasons you are on AP now will keep you on AP for any other visa

as far as I remember you posted that your K 1 visa got denied after 12 months as they think you are married,so now what????

yes they said ur case is denied and i should get letter last week but still waiting for the letter, i was thinking about exceptional cases.

Best thing at this point is to get officially married and file for the CR-1. I know you don't consider yourself to be married and the embassy does but best to make it official-official to avoid any future problems.
