Help - Wrongfully Denied

Hello All,

Can anyone assist me I received a denial for to Remove conditions on Residence, for failing to appear for biometrics. The problem is that I NEVER recieved the letter with the appointment location or dates. I'm certain that the address is correct since I haven't worked which leaves me to conclude that it either delivered incorrectly or is still lost in the mail. I futhermore I am unable to work, travel or what appears to be anything. I have approached a lawyer but am uncertain if the additional cost will get anywhere, also not sure of the quality of the lawyer. If anyone out there knows of a good immigration lawyer that resides in Houston that would be ever so helpful. Meanwhile I realize that I must act fast and file an I-290B Notice of Apeal or Motion. Is there anything else I can do?

the I-290B will cost you $585 even if it was there fault like a wrong address..I can also tell you that I filed a 290-b back in june on a denied 485 and I am still waiting for a decision..my file hasn't been touched since Aug 17.. Good Luck

The best thing you can do to avoid this, is sign up for case notifications. i can not stress that enough! it will update when they send you anything. if you don't get anything within a week or so after they said they send something out, you can contact them, so they have it on record that you have not gotten anything, and they will either resend the notice or make a diff appointment.

I have mine set up that they email me whenever they update any of my paperwork. so i don't have to go crazy looking everyday (even thought I do sometimes anyways :lol: )

I know this doesn't really help after the fact, but this is for others that may be reading this that do not have case updates.

if anyone needs help setting that up, id be happy to help!

The problem is that unlike other types of applications, when Removing Conditions, your case file number is on your Biometrics appointment letter (not on your NOA). If you don't get the Bio appointment letter its not possible to sign up for notifications.

Dec. 27, 2011 OATH! US Citizen

Thank Jen, but Anne is correct I tried to set up notifications like I did throughout the other processes but because my receipt number was not in the data base I could not do so.
