Hi i am asking this question on behalf of my friend.

His wife came here on K1 and got married to him. i am helping them with thier papers.he does not have no income (disabled)and he has arranged a person who is willing to sponsor his wife for AOS. My question is that, the sponsor would have to fill Form I 864? or I 864 A ? 2nd question " Since he does not have no income, does he still have to file I 864 form for his wife too or only sponsor would have to fill that?

Quick reply would be appreciated because her status will be expired on 25th of this month.

The USC spouse always completes the I-864 as the primary sponsor regardless of income.

If the co-sponsor does not meet the quaifications for household member then they would complete an I-864 themselves. If they do qualify as a household member then they would complete the form I-864A.

Both persons submit all needed documentation with their respective I-864's.
