06/20/2009 - Met online ( I am from Philippines and he's from Wisconsin)

04/26/2010 - Met in Philippines (for 2 weeks)

05/08/2010 - Officially engaged!! ( He sent the engagement ring 09/24/2010 and he proposed to me on bended knee in Philippines with the second part of engagement ring) *melting*

06/18/2010 - I-129F package Sent

06/21/2010 - NOA1

06/24/2010 - Touched

09/23/2010 - Touched (when I contacted the Congressman's office)

11/15/2010 - Touched (hopefully the approval)

11/17/2010 - NOA2 (Received hard copy 11/22/2010)

12/01/2010 - Received a letter from DOS dated 11/29/2010 stating that the petition will be forwared to USE AD within a week and that I will received the packets very soon from embassy.

01/18/2011 - Interview. APPROVED!!! No words can express how happy i am.

01/25/2011 - VISA in hand! YAY!!!

I'll let you know what happens. The letter from the NVC is interesting. On the first page (Before your petition can be processed you must pay the Affidavit of Support (AOS) processing fee) On page #2 (1. If the applicant intends to adjust status with the U.S. Citizenship and Immigration Services (USCIS),

please contact the NVC before making any payments or taking further action.). So there giving me the option of a immigrant visa or a non immigrant visa in those two statements. I'll fight them for a little for the K3 but if i need to I'll give in to there other visa. Ya this K3 visa is a mess now so best just forget it!!!!!!!!!

I-130 vs I-129F.

Then

some point tonight or tomorrow, call in to NVC, inquire about status on the I-129F.

Paying Fees is for a CR-1/IR-1 visa.

They got the K-3 visa wrapped up in so much red tape now best just forget it. They want the Affidavit of Support in place before the foreign spouse sets foot in the USA. They don't like the 1 year and 9 months you had with the K-3. Years ago they tried to make it illegal for a us person to marry a foreign person. Now there trying to scare us out of it with all the laws they put in place. I really wanted the 1 year and 9 months to see how things go when she is here but they took that away from us now!!!!!! CR-1 here i go.

I sent an e-mail saying I intend to adjust status with the U.S. Citizenship and Immigration Services what would be the K-3 visa. Then a few days later I got a letter saying they closed my 129-F. then a few days after that the NVC sent me an e-mail saying The NVC does not process adjustment of status cases. Then I gave the NVC a call and they told me my wife's address is the same as mine so no need for a visa cuz she is in the US so they closed my I-130 also!!!!!!!! When i told the lady that all the e-mails and letters from the NVC had her address in the Philippines she said no her address is in the US and that was it. Don't piss of the NVC trying for the K-3 visa.

I got my case # from the NVC today but never got a txt or e-mail from the CSC. I did find my NOA2 for my 129F and I-130 in the mail today. It was approved a few weeks ago.

When i told the lady that all the e-mails and letters from the NVC had her address in the Philippines she said no her address is in the US and that was it. Don't piss of the NVC trying for the K-3 visa.

errata:

1. I-129F's are closed when they travel together from NVC to USCIS (and 99 percent of the time, they do travel together) - see K-3 administratively closed - http://www.visajourney.com/news/2010/02/07/department-of-state-to-close-k-3-visas-if-i-129f-and-i-130-petitions-approved-and-received-together/

2. adjusting status with USCIS usually means 'all is done in USA' - no K-3 visa or even CR-1/IR-1 visa - simply file for AOS with I-130 and I-485 filed concurrently, should yer lass actually reside in USA WITH YOU at the time of filing.

3. I think you should really found out what is what, and what is where - as you've some hope of doing NVC processing (I-864, DS-230) in the next few weeks - hopefully you can suss it all out, figure out what it what - by calling into NVC, getting a supervisor, and inquiring for casefile status on the I-130.

Sure - someone 'said' they closed the I-130 - but if it was closed in error - it'll be YOUR error - and your wife will think you most foolish.

I got the NVC to reopen the visa and they got all the paperwork they need last week. I just love how there policy overrides the LAW!!!!!!!!!! The K3 is part of the life act.

Are you saying you got them to reopen the I-129F for spouse and to proceed with the K3 visa process? If so, how did you accomplish this?

(I'm going for the IR-1 and blowing off the K-3. Even if it takes an extra couple months, it's worth it to not have to deal with USCIS again)

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

The K-3 is still law but the NVC policy overides the law!!!!! I dident want to fight with them to much just want my wife here so went the CR-1 visa.

I must assume if you were issued an APPROVAL on the I-129F PETITION, then the I-130 petition was approved as well, and further assume the approved I-130 petition has made it's way over to NVC office.

So...

Suggest you pursue the CR-1 visa processing/paperwork

at NVC

with the DS-3032, I-864, DS-230

and hurry hurry .

oh - please note - you 2 case #'s from USCIS - one on the I-130, one on the I-129F

and

TWO case numbers from NVC (not the same as USCIS) - one on the I-130, one on the I-129F.

I'd like to wade through the p|ssing and moaning and try to help you with actual process,

but

I am having problems with yer language and my understanding of same.

Help a fella out? If she's not here in USA, she needs a visa.

If she's in the USA already, then she needs to adjust status.

Pick one or the other - don't mix/match to suit yerself - it's a waste o time and monies.
