Hi everyone,

I know I asked this question before but I'm really confused. I don't know which one is guaranteed to get K-1 or CR-1

I've been denied before twice for a student visa 2 years ago, and before I stayed in the US for long periods ( but never over-stayed),,,and the lawyer is trying to convince my fiancé and I to go with the K-3 because its a right for an american citizen to bring his foreign wife to the US. And he says its never denied.

So I would like to know your opinions. I'm really confused which one to go with K-1 or K-3 or CR-1

You're never "guaranteed" to get any visa. The K-3 is effectively dead. your choices are either Cr1/IR1 if you get married first and then file, or K-1 if you want to file before you get married.

Yea right. Nice sentiment but has no bearing. We did the K-1 because it's fastest.

And he says its never denied.

Will he give you a full refund if it is denied? This false; if you have a sham relationship and they find out, you'll could be denied, regardless if you are married or not.

So I would like to know your opinions. I'm really confused which one to go with K-1 or K-3 or CR-1

Why did you hire a lawyer to start with? go ahead and fire him, he's useless and you're better off, believe me!

K-3 is administratively closed, if they get your petition, they'll throw it away.

CR-1 is for married people, takes longer than K-1, but has lots of advantages:

- You can work right away

- You get your Green Card and SS# right away

- You don't pay for AOS

- You don't need an advance parole to travel outside the States.

K-1 is for engaged people, so you get married in the US, not Egypt, either legally or religiously, because religious weddings in Egypt are legal, it takes about 6 months.

K-1 and CR-1 are different from student visas, because basically, the American petitioner has the right to bring over his fiancée/spouse, as long as they have a real relationship and the foreigner isn't a threat.

Don't just try to pick what's "fastest" because K-1 and CR-1 can take longer, or shorter, just pick what fits your situation.

K-3 is dead, so no need to even bother with that

K-1 is faster, but the CR-1 spousal visa is cheaper and allows for immediate work and travel

You need a new lawyer, spousal visas are denied and there is absolutly ZERO RIGHT for a US citizen to bring his spouse over to the US - it was never written into the constitution. Unless someone can post the exact ammendment which specifically states (not your interpretation of a ammendment) that a US citizen has the right to marry and bring a foreign spouse over to the US - I'm all ears. In fact, ask your lawyer that question as well
