I have read posts from a number of people who have had problems with Nigeria. To paraphrase what one experienced immigration attorney once posted to an immigration board, 'the scale for immigration fraud at consular posts is low fraud, medium fraud, high fraud, Nigeria'.

I believe that anyone who is dealing with Nigeria needs at least a consultation with an immigration attorney who has had experience dealing with that post. Check the AILA web site to see if you can find any US immigration attorneys who practice there.

If I understand your posts correctly, you've been married to your husband for well over a year now but you haven't been back to Nigeria to visit him in that time? You are not helping his case any with this behavior.

Well you should not judge me seeing how you don't know the whole story.

I plan on going back over there but because of my health I am unable to travel at this time. I am headed back to my doctor to go thru yet another operation by myself. :( My husband is heart broken that he can't be here to take care of his wife. But he supports me the best he can with his prayers daily and his phone calls and his texts to me and emails me and also leaves me instant messages to help me to stay cheered up.

I was how ever contacted this morning and was told to go with the I-130 but to tell them ever thing about the I-129 and I am still looking for a lawyer who has dealt with the Lagos post before. and to be sure to send all the things I have to prove we are in and have a Bona Fide marriage.

I am not judging, I am making a point as to how the consulate judges - on the basis of the information that has been provided. Be sure that they have the information they need to see the situation the same way that you do.

I was able to talk to a lawyer today. Wonderful news I have appointment on the 15th of this month.

How many times have u, and ur hubby been married before?

Were u married to another foreigner before?

I will answer one of your questions NO I had never been married to a foreingner. Also part of another one my husband has never been married before. As far as our ages we are both adults not children, nor teeenager. But I will say this our ages is more than 10 years and this is a red flag to immigrations. But love knows no age.

It is not like we just meet and decided to get married we met on line and became good friends and praying partners for over 4 years was engaged for almost 6 months lacking 5 days. He was unable to get a visa to even come and visit me so I went there to see him. Was there from March the 27th till May 5, 2005 we was married on the 23, of April 2005 and had a wonderful honeymoon of 13 days before I returned to the states to file the paper work to get him home. We was told I had to come back here to do the paper work.

The women who done the first interview was American women who was very rude and done nothng but yelled at my husband and treated him like he was a dog not a man. She even went as far as telling my husband he could marry a nice women there who can have children. My husband told her children is not the reason we married and is not our top priorty. My husband told her we are planning on adopting and it set the women off to even treating my husband even worst if that is possible. She yelled at him for over 3 hours laughing at him even got her co-workers was peeking around the conner laughing at him when she went to the back to talk to them. This was a embassment for my husband to be treated like this like he was a freak show or somethng. My husband is a very well educated man and had never been thru any thing close to what he went thru that day. But he looked straight into the eyes of this women and said I married my wife because I love her. That is when she left the room and came back and said the divorce paper was not right and ask him to get the orginal from me and it might be six monts before he was called again while they done a investigation. They went to see my mother while she was sick and ask her who in this picture do you know she only knew her son she had never seen a picture of me. They never even ask her if she had ever talked to me or gotten mail from me. Which by the way she had we never got married where she lived we got married in the home town of my husband place of work and where he lived. She was to sick at the time to travel to the wedding but we called her before and after the wedding and we both talked to her. She knew I was there and that we was getting married and she is a wonderful women by the way. Sorry this is so long but hope this answers some of the question you might have of our relationship. I got to go and call my husband. I will try to figure out how to do a time line later.

i just read your post and sorry to hear that you got treated in this way. Last year in october, the same thing happened to me at the lagos consulate. the chinese guy who interviewed me was very rude, made fun of me and my husband, and made very unpleasant remarks about my husband and myself, all of which have nothing to do with the interviewing a beneficiary of a visa petition.

my husband now, is the us citizen and i am the nigerian citizen. the petition was a k1. after all the geering, the guy came to the window and informed me that he was going to return the petition because we did not show adequate proof of relationship and blah blah blah.

i am a lawyer in nigeria by the way, but at the time i did not realise what our rights were as to the procedures that should have been followed by the consular officer before he could have even dared to return the petition.

at my interview, i had a joint bank statement, some photos, some cards he had sent me, about 400 prepaid calling cards, yahoo chats and money transfer documentation, which were all rejected by the officer. unfortunately, by observing other interviews i realised that the cons officers in lagos need to see hundreds of emails and photographs before they even talk to you. these i did not have because we had not printed out those documents.

the law is that when an applicant does not provide enough documents, he should be given another chance to do so... and should be told what exactly he needs to bring. we were not given this opportunity.

exactly one month later, the file was returned to the DHS and in march this year, the (vermont service centre) they contacted my husband and requested that he present further evidence to support the relationship within 60 days. the procedure varies depending on which service centre.

DHS usually reviews the case and when you submit enough evidence, they return they reaffirm the approval and return the file to the embassy so the applicnat can be issued the visa.

there is another thing though, this whole process may take a while so what you can do is to go to the embassy in lagos or your husband can go there and seek audience with the consular officer or something like that. for one thing, they usually keep the file for about a month before returning it. during this period, if he s able to consult someone at the embassy, then he may redeem the situation before the file is returned in which case he should state clearly what happened and what documents they need him to present. i would suggest that he attempts to see either the consular officers or the Consular general. he might be lucky. that should be your first port of call. you may also call the ACS at the embassy, they are very helpful - 234 1 2611215, 2610195, maybe someone may tell u how to make an appointment with the consular general. otherwise if the file has already been returned, then u may need to use the services of an immigration attorney, there s a man called Marc Ellis, who writes several articles on immigration law weekly www.ilw.com. if you have any background knowledge of the law, the articles on that website will help u prepare your evidence in rebuttal. other wise contact mr. ellis on marcellislaw@gmail.com. if you read his articles on that website you ll see that he s an immigration attorney who knows a lot about these immigrant visas and the problems at the consulates.

my husband and i have sent in our appeal to DHS and are awaiting their decision. we didnt have to use a lawyer because i prepared the arguments for appeal.

Age difference in and of itself is not necessarily a 'red flag', especially when the difference is only 10 years or so. What makes it a 'red flag' is some additional factor.

Is your husband by any chance younger than you?

The lawyer I talked with has ask me to bring everything I have sent to them. He talked with me in great lenght about everything and said we had done everything right but he needs to check all the paper work plus to bring in everything I have that can prove we do have a Bona Fide marriage and yes he also said it sounded like we had been railroaded by the women. Seeing how the last woman never even looked at the paper my husband was ask to bring to the second interview to prove my divorce to be legal. We was not ask to prove or bring anything else with him in doing this they are not for filling thier requirements. They over steped the line many times in ther interview with my husband.

So I am working on getting everyting together leaving no leave unturned. Like Christmas I am making a list and checking it twice no make that triple.

Also may God be with you and your husband in your case as well as ours.
