here's my story, i was married with my husband for a year and 7 mos, we had the ups and downs as what married couple have. we had diffferences we argued but there were also times when we would be okay with each other, the thing is i wasnt really able to tell him what i really feel inside whenever we argue...he is so dominating and every attempts of talking would fall into deaf ears...i had to succumb to his wishes and found out later that i lost my own personal being...there was even a time in our marriage that all he wanted was to use me...forcing himself against my will...then at the later part of the marriage he started to become so possessive with me...its like an obsession...to cut it short i became unhappy with my situation...at a later part of the marriage i met this very good man, he was my friend and my confidante. we dont know what happened and how it happened we just realized one day we love each other...ironic isnt it? some may judge the person in me but that was it i was unhappy with my marriage. My husband knew about it and so we had to separate, my husband said i have to pay off my debts with him...i was fine wih that...im paying him a good amt every month for the debts i owe him(we had to make a loan for my mom and its under his name)...my husband said he would sign the conditions to lift my status so long i pay him off my debts...he wanted to deport me...i guess he still does...so im concerned now regarding my stay here...my visa would expire next yr of june and i dont know what to do...im willing to go back to philippines if thats the case but is there any chance that i can stay? he is harrassing me everyday,to the point of me getting sick and getting panic attacks...i have never heard such bad words in my entire life...i onced loved him...i may have made a mistake but it always takes two to tango...if i were happy...if i was just treated with respect...but that wasnt the case...now im at a losing end...i love this guy who i am with right now...im very much happy with him...but will i get deported? can i still apply for the conditions to lift my status? please enlighten me...i have built my life here already i have a stable job...now im concern regarding my status...can i stay or will i have to go?

You should have some legal recourse here,. Since it looks like the divorce will be finalized before the GC will be issued in that case you'll have to file for a waiver of termination. Some of the grounds for that waiver are: extreme cruelty and abuse from USC spouse, extreme hardship if deported and good faith marriage. The OP already has her GC therefore this doesn't apply to her.

OP - You can apply for ROC by yourself and this is how you will have to do it because if you are not together, filing ROC as if you are is fraud. You will still need to show that you were in a bonafide relationship with your ex. Do you have proof of bills to the same address? Lease? health insurance in same name? Anything to show that you were a legitimate couple at the time? How about proof of you giving him money such as checks, or prints of transfers from your account etc. Photos together...

You should file for divorce now. You will need to file ROC as soon as the divorce is final OR in the 90 days prior to your GC expiring, whichever comes first.
