1. I need to know before filing in London for DCF does my husband need to be in the US with a job first

and therefore does that mean he won't come to the interview?

2. What exactly is the benefit of an attorney?

3. I have an abandoned case from the US as my husband couldn't sponsor me as he hadn't sufficient income for the previous 5 years and I needed to sell my UK flat to raise funds. I have an approved I-130, can I use that in

London or do I need to start over with everything again?

4.How long does it all take and how soon after approval must you leave? I mean if I was studying here on a course that ended next June and they said in March I could go,must I leave then?

Hello

1. DCF is in existence for couples who live together outside the US and wish to move to the US together. In most countries this is not suitable if your husband is in the US, and in particular for London there are residency requirements for the USC.

2. In what circumstances?

3. I don't think this is enough information for anyone to answer. Perhaps check with the consulate?

4. The visa (if you were to go the DCF route) once received is valid for six months.

1: Not necessarily, if your husband is the USC. The USC is not required to attend the visa interview either way.

2: That is a question for an entire thread. I recommend a search of google groups alt.visa.us.marriage-based on the words attorney + benefit to find several long threads that have covered the topic already. Read them and consider your own circumstances.

3: That would be a good question for the Visa Unit at the London Consulate. Don't phone, email them. Provide all the case information you can, including where you last left the I-130 (NVC, Diestrict Office, Service Center etc)

4: London cases that move right through take 3-6 months to my best recollection. The visa is valid for 6 months after issue (you must use it within that time). You will have control over when you take the visa interview, so you can control the slowing down (but not speeding up) of your visa issuance.

September 2000 - Met at the University of Salamanca, Spain

January 2002 - Move to Washington DC (Emily with J1 Visa)

September 2003 - Move to London - Chris studies for MA - Student Visa

7 July 2005 - Married in the UK - Chris gets UK limited leave to remain 2 weeks later

June 2006 Decide to get IR-1 / CR-1 for Emily - plan to move to NY

1 July 2006 - I-130 Sent to London Embassy (Direct Consular Filing)

5 July 2006 - NOA1 Received

15 Sep 2006 - NOA2 Received - I-130 approved! Application sent to NVC

22 Sep 2006 - Packet 3 Received
