Hello,

I applied for my wife for I-130 and it got approved.

I paid the $404 like a week ago, and I checked it it says "PAID"

Now this is my situation...

for form I-864, I submit my taxes with my parents as their son.

So when I came to do the affidavit of support form, I kinda got lost between the terms.

Who should be the sponsor? is it me cuz I'm the petitioner ? or my dad cuz the taxes are done by his name ?

If someone had a similar case, or if you know anything about such a situation please provide me with what you know,

thank you so much

Also it says in the step-by-step instructions for form I-864 in explaining part 5:

"This section asks you to add together the number of persons for whom you are financially responsible."

I'm not responsible for anyone, rather my parents are responsible for me, in terms of taxes papers.

So do I complete this form or no?

The petitioner is always the primary sponsor and completes the I-864 regardless of income.

If your income does not qualify then you will need a joint or co-sponsor. If that person is a household member they would complete form I-864A. If they do not meet the guidelines for household member then they would complete form I-864.

Any person completing the I-864 or I-864A must be sure to include all of the necessary supporting documents. Refer to the instructions. This I-864 FAQ can also be helpful >> http://travel.state.gov/visa/immigrants/info/info_3183.html

Section 5 (for your I-864) will be 2 people, you and your wife.
