Timeline

When I made the thread, I was a little confused about where it went, since the AOS timeline has nothing about the i-130 or anything, so I figured I'd make an i-130 filing thread for those sponsoring their spouses, as they went through the process. In retrospect, I probably made a newbie mistake in where I placed my thread, since my wife is already in the US, and we are filing for AOS, too. In any case, please feel free to use this thread and the best of luck to you and your wife! :)

Thanks for the response khthon. No worries, I remember my first time through here quite well. And though it has been 5 years since I completed that journey, it's all coming back to me on the anxieties and confusion that is inherent with this process. Well your confusion (and mine) is understandable as explained by Khthon above. So to answer your question...you are filing for an CR1/IR1 visa which means you are already married (and judging by that handsome wedding photo, you are indeed married). If you are married for less than 2 years (Conditional Status - CR1), you will need to file for an Adjustment of Status (AOS) at the 1 year 9 month mark of the time your wife arrives in the US. You will have to go through getting biometrics and submit yet another package proving your relationship is bonafide. If successful, your wife will be given a 10 year Green Card. However...if you have already been married over two years when your wife comes to the US, you will get a IR1 visa and after entry into the US, your wife will be issued a 10 year Green Card. Hope that clears up that question for you.

Wait, is Adjustment of Status the same as Removal of Conditions? I thought AOS was for K-1/fiance, and ROC was for CR-1/spouse. #######...

I-797 = the receipt = NOA1?

Is the biometrics appointment a separate letter from all/any of the above?

Does it show on My Case Status when the biometrics appt has been mailed?

Wait, is Adjustment of Status the same as Removal of Conditions? I thought AOS was for K-1/fiance, and ROC was for CR-1/spouse. #######...

My deepest apologies for the confusion. Kikapoo is very correct! AOS (Adjustment of Status) is for K1/K3 visa filers. Removal of Conditions (I-751) is for CR1 filers who have been in the US for 1 year 9 months. I'm staring at that petition and feeling very happy my stepdaughter won't have to go through that. I feel very embarrassed right now...got to get my head in the game! :wacko:

OntheRocks, I'm hesitant to assist you after my last screw-up with my misleading info on AOS vs Lifting of Conditions, but I think I have your question pretty solid so here goes...

I-797C = Notice of Action (NOA). Form is used for several different purposes. The key is to look at the "Notice Type" field. If it says "Receipt", then it is your NOA1.

Your biometrics (if the same as the one for Lifting of Conditions) will also come on a I-797C but the Notice Type will state in bold letters ASC Appointment Notice". It will contain instructions on what to bring (the ASC Appointment Notice & photo ID), time/date of appointment, and location of facility. Important, there is a very bold sentence there that essentially states if you miss your appointment, your application will be considered abandoned. YIKES!! Give yourself a lot of time to get there.

Not sure if your Case Status will show if the appointment letter was mailed. You would think it should. Hope this helps.

1. Do you think simple cases are handled quicker?

2. Do you think some origin countries are handled faster than others?

Assuming no RFEs.

Hello and Welcome!!! First, I give you my best wishes for your journey and hopefully it will be a short one. Regrettably, the words simple and USCIS are not the same. No ones case is ever simple therefore you can expect to endure the same wait times as the rest of us (sorry!!). Yes, some origin countries are handled much faster than others, so you may find some luck there. Keep in mind, your only job right now is to convince the USCIS that you have a bonafide relationship by THEIR definition. You've only been married a month so between now and the time you have reached the interview stage, I would be collecting up all the evidence you can so ensure a successful conclusion. Good luck.

*pokes her head in* Hey, there's an October filing thread here, too! *waves to everyone* Just filed my I-130 the 30th Oct, was received by the lockbox yesterday. Am trying to be patient and only refresh the online banking page twice a day to see if the check has posted to the account yet. ;)

Well let me tell you form experience getting residency in other countries is not this hard had mine from phil in 2 months lol. Of course there it is pretty much showing the paperwork paying the money and waiting for manila to take two months to print the card lol. Hoping this helps my proof considering i actually lived with my wife 6 months of our 1 1/2 year marriage in her country and the passport stamps and temporary resident card copies sent as proof. Phil is nice just not ready to be that bored everyday :) Maybe when we retire lol.
