Hello There,

My fiance is a USC and will be filing the Form I-129F very soon. Right now, I am preparing any required documents needed in advance.

One thing that I have no idea where to obtain is a US police certificate. The reason I will need it is because I had stayed in the US for 8 years before returning to my home country. According to the instructions in Packet 3 (from the US Embassy Web site in my home country), "...the applicants must obtain police certificates from all countries where he/she resided for one year or more."

I emailed the US Embassy asking them. Unfortunately, they were unable to give me an answer.

So, I hope some of you here know where to get that certificate. Who would be able to issue a police certificate for me? A local police station in the area I used to live? or the FBI? My fiance and I have no idea what to do.

Surmising that you lived in the same city during your stay in the U.S., you could get one from the local police in that area.

I believe you would need to do this personally, due to privacy issues. Local police have access to FBI NCIC records. With proper justification, which you have, I am sure the local police from the area you lived can pull it for you.

Just wanted to pass on my experience....my husband lived in the US for four years prior to applying for the K-1 visa. I (the USC) contacted the consular section at the embassy to see if he needed a police certificate to cover the time that he lived in the US, since I had read somewhere (this site, I think) that it wouldn't be necessary. If I remember correctly, the consular assistant first told me that he needed the US police certificate, but then the consular officer said no, he didn't. After all, they had to run FBI name checks on him before granting the visa. And yes, he did get approved without having a police certificate from the US.

You say that the embassy was unable to answer your question. Does that mean they were unresponsive, or didn't know the answer? My fiance and I found it was best for me -- the USC -- to communicate with the embassy, because they seemed more responsive to me.

One more thing -- see this thread on the subject of whether or not K-1 visa applicants need a police certificate to cover time they lived in the US:

If you use this sites search feature and do a search on "US police certificate", you will find the same answer over and over and over again -- you do not need a police certificate for the time you lived in the US.

Yep, my bad. They (US Goverment) will check you out automatically with NCIC, for your time in the US.

It would be nice if a US police certificate is not required as one of the documents that need to present on my interview.

I am still wondering, though, why it is stated on the instructions for immigrant visa applicants on the US Embassy web site (RE: http://bangkok.usembassy.gov/services/visa...eck%20list.pdf)

Or it is required only at the US Embassy in Bangkok?

Anyway, I think I had better have it in hand just in case they ask for it. I heard that a thai woman who went to school in Singapore for only 6 months was asked for a police certificate from Singapore on her interview.

I had lived in the US for several years as well, and I did NOT have to get a US police certificate for my K-1 visa (I did have to get one for my homecountry). They do FBI checks for the US anyway, so I woudn't worry about it.

AOS timeline:

03/17/06 filed for AOS

03/28-06 touched

04/04/06 biometrics

04/05/06 touched

05/23/06 transfered to CSC

06/17/06 touched

08/16/06 touched

11/20/06 USCIS cust.service started inquiry about case (because it's outside of processing times)

11/30/06 approval e-mail

12/07/06 Greencard in the mail (= 8 months and 21 days for the entire AOS process)

No police certificates are required for US, since the USCIS will do that check for you.
