There is the very real possibility that I will have a new job by the time of Wes' interview, but will not have started it yet. The wages put us WELL over the poverty limits.

Under our present scenario we are using a co-sponsor. With the new job obviously we wouldn't need that.

So......will USCIS take an I-864 under that scenario? I could probably get a letter with my start date and new salary. I expect I would be starting this job within a couple of weeks of the interview.

Of course, I would have no pay stubs or anything else to substantiate the job other than a letter.

I would really love to do the AOS without the co-sponsor if possible.

I kind of doubt it. An offer letter is not a job -- they may reneg on the offer, you may change your mind and not start it. I think you are stuck with a co-sponsor.

12-08-2005 Biometrics for AOS and EAD. Having no EAD appt letter was no problem (used EAD NOA)

12-15-2005 EAD arrived in the mail

12-24-2005 Received interview letter; interview scheduled 03-01-2006

01-28-2006 Received replacement SSN card in married name (5 wks since application)

03-01-2006 AOS interview -- approved; received stamp in the passport

03-13-2006 Green card arrived in the mail

Is it possible for you to start sooner? If the issue that you plan on giving your employer 2-week notice, then maybe you just don't do it. It's not required (at least in my state) to give any notice -- the employment is at will and may be terminated by either side at any time.

Well, the bigger problem is that the 'decision maker' is not going to make the decision till the first of March. I expect to hear something from them (one way or the other) on Mar 3 (Friday) or March 6 (Monday).

I guess I could just walk out on my old job, but I hate too. Plus the 'decision maker' seems to be the conscientious sort who told me he fully expects his new person to give a sufficient notice to make a proper exit from their old employer.

If I get the job, that's definitely what I will try, kc.

I've wondered all sorts of things. Like if they would 'delay' the green card say a month or so, until I could submit an affidavit after my start date with a pay stub.

Looks like I will be going to our interview carrying a boatload of I-864's *blah* :P

This interview came upon us so soon - we only filed the AOS in Mid-November. And here's another *blah*. Should Wes find a job between now and then, we can't count his income. The interview date is ONE WEEK shy of him being domiciled in the states with me for 6 months!

Unfortunately I have no real advice to offer on this situation. But I do hope that it all ends up okay.

Mainly I wanted to congratulate you on the new job offer! Here's wishing the best of luck that it all goes according to plan and you find yourself swimming in piles of money ;)

At my interview the interviewing officer asked if everything was the same (employment) and I said yes and added that a litte raise is schedulef for March. He flipped back to the I485 then and that was the end of the I864! Good Luck

Well, you know there's no way to make a prediction of what your specific officer will do, so all you can do is go prepared to make your best case (congrats on the new position!!!).

I don't see how you could necessarily complete a new I-864 with the new info, but if you did, and the officer doesn't accept it, shred it.

You could take all the new information in, as official as possible, and make your case in the interview. The officers are allowed to ammend your previously submitted I-864 if you have new info.

Worst case, you're still employed, have a (better job) hiring date confirmed and a Joint Sponsor. You're covered an which way.

Interviews are good because you are there to explain your case and the info you have in it, and can have a back and forth with the officer. One might even think they could influence the outcome :) Add in additional factors, like your immigrant is already employed (bring his proof of income etc) and his info might be added in by the officer or merely influence his/her decision (or not :) ). IOW, all you can do is throw all you've got at 'em and hope for the best. At the barest minimum you are still approvable (financials).
