Timeline

Hi everyone. We have a family friend who has filled out the affidavit of support for us. My question is, is this sufficient to have him as our one and only sponsor? I'm reading alot about co sponsors here and just wondering if our sponsor is enough on his own. Does this make sense?

October 8th- Sent off K-1 visa package

October 21st- Received email saying we have been assigned to CSC

October 28th- Waiting on NOA1

October 29th- NOA1 received!!!

March 16th 2011- Received email saying petition for fiance has been approved and that NOA2 is in the mail!

April 12th 2011- Waiting on lettter with interview date from Dublin Embassy. Medical scheduled for 26th April

Your family friend is the co-sponsor. You or your spouse, whichever is the US citizen, is the sponsor and will have to fill out an affidavit of support as well. It won't matter if the income is $0, but still has to fill it out.

12,000 is not close to enough. You would need a cosponsor that can meet the income or assets requirements by themselves. There is no adding together of incomes or assets for I-134 sponsors. Assets are considered at either a 3:1 or 5:1 ratio. Meaning $3 in assets (stocks, savings, investments) = $1 in income.

Hi Aoifemc,

I think you might have misunderstood what JoannaV was trying to say. For the purposes of the K-1 visa, the USC petitioner is ALWAYS the primary sponsor. Even if the USC makes no income whatsoever, the USC is ALWAYS the primary sponsor. If your fiance has savings of $12,000 he can put that on his affidavit of support, but it won't be enough to satisfy the required amount. If you use assets they have to be equal to 5 times as much as you'd need if it were income because the affidavit is in effect for 5 years. You will need a co-sponsor to make up the difference.

Hopefully that made things LESS confusing rather than more, as I know these things can be such a headache. :wacko:

So which is it? I was under the impression that assets had to be 5x the required amount, not 3? I could be wrong of course..

The answer is: it depends. :blink:

From the I-864 FAQ found on the State Dept. website ( http://travel.state.gov/visa/immigrants/info/info_3183.html#6 ) :

What Cash Value of Assets is Needed?

The total net value of assets, less liens and liabilities against them, must equal five times the difference between the sponsor's income and 125% of the poverty level for the household size

Sponsors of spouses and children of U.S. citizens must only prove assets valued at three times the difference between the poverty guideline and actual household income.

Sponsors of orphans who will acquire citizenship after admission to the United States must only prove assets equal to the difference between the poverty guideline and actual household income.

Just read the guidelines for minimum amounts and co sponsor makes more than enough to qualify very comfortably. so is this ok?
