Hi out there!

My husband is about to file his I-130, but after doing more research today I'm not sure when I can file my I-485. I read that:

1) the I-130 is filed first and when we receive a notice about it, either as approved or pending then I can file the I-485 or that;

2) I-130 and I-485 can be filled at the same time.

Which is he right filling process??

Help pls!!

Hi Mab,

Are you in the US or outside of the US right now? If you are in the US, what type of entry did you use when you came into the US? (What visa, VWP, K-1, B-2 etc) And when does that status expire (on your I-94 card in your passport)

Hi,

I'm the US right now so yes we will be filling in the US. I entered the US on a B-2 visa and it will expire on oct 27th. i know that I need to have filed before that, but still wondering on the proper filling procedure.

Well, in the guides section (link at the top of the page) you'll want to follow the guide for when both of you are in the US. Here is the link: http://www.visajourney.com/content/i130guide2 I hope you'll read all of it carefully, it has the answer to your question which is that you file both of them together.

Another really useful resource are the example forms (link at the top of the page) which help to solve some of the nit-picky little fields where a lot of people feel unsure of what to write.

For AOS, you send I-130, I-485, and I-765 concurrently.
