Expedite Request..Foiled again Batman!!!

Ok, so some of you know we filed for an expedite request on sept 28..they requested my step daughter's medical record because she has Cystic Fibrosis, which is a nasty condition with no cure. So almost two weeks go by...my wife called last friday to see what was up..the Tier 1 informs her that there was a decision, but we weren't notified by mail, email or a phone call. So the Tier 1 sends another request to see, What's UP...for a case update, because we didn't hear anything. Today at 3 pm, my wife receives an email..an RFE...requesting information from her daughter's physician and to put things into Laymens' terms..which for some of you, who English isn't your first language, means to dumb it down. Asking if it was an acute or chronic condition, blah blah blah..so pretty much had to wait for an RFE for two weeks, after my wife had sent them documentation diagnosing her daughter with Cystic Fibrosis. So, anyways...wife called the hospital, I believe they're going to 'take care' of it tonight or tomorrow and fax it directly to CSC. Then they will make a determination if we qualify for expedited processing. Like they couldn't have just looked on the damn internet like on WebMD and gotten their information. This is why it takes 5 months to process this #######...not because they're slammed, because they're inefficient.

theres the mayoclinic too, i know that consulates look at that. The day after we made the expedite request, we had that exact same email, then 4 days later we had a hard copy in the mail.

Keep on like a dog with a bone though mate, it was only after Id email god knows how many times and asked for receipt of fax...and then got a sig from the signed for mail. What is amazing about the whole process is why they want it dumbed down!! Ive done a bit of research and found out why. It remains to be seen if our expedite emerrgency will be cleared - if it isnt I have a feeling I know why and I'll push it with congress. In fact we've already got the senator informed but if its a negative decision I think, for medical its an absolute disgrace if proper emergencies are denied expedite.

Ok, so some of you know we filed for an expedite request on sept 28..they requested my step daughter's medical record because she has Cystic Fibrosis, which is a nasty condition with no cure.

The problem is they have no medical training just like the folks here on VJ have no immigration legal training :0 That said I would not trust the process to the medical folks faxing something to the CSC.

Make up a letter with the treating physicians letterhead information or get letterhead from his office, you put the following information on it using medical lingo and laymens terms and get the Dr. to sign it, its typed its neat they can read it and spells out what is going on;

Patient Name:

Diagnosis:

History:

Medications:

Prognosis:

Treatment Plan:

Recommendations: *here goes tying the need for your/spouses presence to improve patient condition

THEN GET Dr. Signature Block and Dr's signature and/or stamp.

*** Dr will not be good at doing this and confused by what is being asked likely what they send to CSC will not help.

Also add information from NIH website (national institute of health) about the condition.

Your letter should spell out why you need the expedite. This is a chronic condition, but that is not expedite criteria, there are lots of folks with chronic serious conditions in this process, its not a ticket to faster processing, but if there is a situation going on that escalates the immediate seriousness of the child's condition that should suffice for expedite. In order to get approved you have to tie the need for the expedite to what emergent situation is going on right now that will alleviate suffering by speeding up this process, not simply proving a condition exisits

We actually petitioned based on financial loss, and the health situation. My wife is by herself taking care of this little girl, requires nightly breathing treatments, nightly feedings through a g-tube..hospital visits once a month, home antibiotics at least every two months and plus the kid is asthmatic. Anyways, I was living with them before I had to move back, my wife is a student..financially, I was covering most of the bills for the household...my wife concentrating on school, plus I took care of my step daughter as well...

Now with new insurance regulations...her daughter's health costs are not being covered anymore, which now my wife has to pay out of pocket..while she has a part time job. My wife is now paying almost $1500/month for what isn't covered anymore, on a part time job. My step daughter's dad only see's her one weekend a month. So, it's one of those situations where financially she can't keep up with paying for meds/copays and also paying the electric bill, water bill, living costs. Last time she had a lung infection about 3 months ago..she was in the hospital for two weeks straight..and at the age of 8, my wife pretty much had to say there with her the whole time..because they dont allow children that young to stay alone. Wife missed 3 weeks of 'work' income. Other family support is few and far between..like take my step daughter for a day or stay with her at the hospital to give my wife a break for a day. I could get into other things, but that's pretty much the scenario.

Oh, in case anyone was wondering, for a Cystic Fibrosis patient..the meds and treatments monthly, on average run about $7000/month.

Well since the RFE is related to the health question, I would still stick with my recommendation on her medical stuff.

Also didn't I see something where since you are from Canada you could approach POE folks with humanitarian parole concerns?

thank you..it's a daily struggle...she's decent for a few weeks, then has an exacerbation, and we're doing benadryl and inhaled steroids for a week. You get into the routine and go day by day. Good thing is that I go visit every few weeks..but I have no job...lost what I had..so everything just sucks.

Not sure if this applies to you, since you seem other wise addmissable.. but you should luck at USCIS website. Also I was wrong you cannot apply at POE you need to mail it in. Also it appears they might view this as a method to circumvent normal VISA issuing procedures. Looks like the processing time might not be helpful on this though.

I will see if I can find a waiver you can apply for at POE..

Also, you might have an issue having lost your job with the financial portion of your packet as you have to prove the expedite will alleviate the

burden immediately. Given it will still take some time for EAD.. not sure about this. In any case good luck
