Two percent of of 2.5 million is 500,000(!) VJ probably doesn't even represent 0.003% of that.

Lucky Jimmy,

You can contact the congressperson once you cross 5 months mark to check the "exact status" again. They cannot expedite this USCIS process. But there is a good chance to get the file pulled out of the dust after this timeframe.

Expedite will be granted only for specific reasons.

It will be 5 months for our K1 also on November 2nd.. I called my Senator and the office checked on my status twice and those are the ONLY 2 times it was touched, I was told, by the Senator Office to wait and if I don't hear anything by the 5 month mark to call back.. To me, 13 October is close enough to 5 months and I am calling the office this week! As other posters have written, the Congress and/or Senator office really don't do much but inquire; I will say that they have gotten faster answers than I got.. Come to think of it they are the only ones who got an answer from USCIS. Good Luck to all of us waiting! I do not understand how some get approvals within 2 months (for the K1) and others are waiting 5 months and more!

Thank you. I called USCIS today, they were friendly and matter of fact....he told me that we weren't out of processing times yet, that five months is just an estimate and they're still approving petitions from March (we filed in April). He said if we don't hear anything in another 30 days, to call back.

Im a May filer for i130 spouse and no NOA2 yet, so I personally went to my congressmans office yesterday so they would have a face with the paper and was given a consent form to fill out so they could inquire on my status. I asked the same question, "how much info can you get verses what I get by inquiring?" I was told with a congressional inquiry the USCIS will give a case status update and the what is the delay within 10 days....better than waiting 30 days with a regular inquiry by me. I have also been told by my attorney that going beyond the 5 month timeframe is not unusual especially if they had an increase in the amount of petitions, which seems to be the case.

What is the difference between an expedite and congressional assistance? Can a petition be expedited if it is beyond the normal processing time?

My petition will be 5 months old since NOA1 on November 2.Then it will be beyond the normal processing time. What options will I have then?

My 5 month was up on Oct 7th, I am now into my 6th month with no NOA2. I went to my congressmans office yesterday, they are doing a congressionl inquiry, this will give me an update in 10 days. You can only expedite in emergency situations and other gov.reasons, they list this on the USCIS website. My advice is for you to wait 2 weeks more and then either call the USCIS and put in a service request with them yourself and wait 30 days for a response or go directly to your congressmans office and get an update in 10 days...call your congressmans office first so they can advise you.
