The 23-SEP-2010 USCIS Fact Sheet left me scratching my head. It states that the fees will, on 23-NOV-2010, be as listed in the fact sheet .

For instance the I-485 is listed as going from $930 to $985. It shows the Biometrics going from $80 to $85. So the new total for a K1 Fiancee filing for AoS is clearly increased in the AoS process to $1070.

But the USCIS currently sets the cost of the K2 children when submitted with the K1 Fiancee at $600 even including the Biometrics. (I sent the USCIS a check for $1610 with my wife and step-daughter's applicaitons last year.) The Fact sheet does not mention the K2 applicant on the AoS at all! Does the lack of metioning mean that the fee will stay at $600? Or does it nean that all I485 appilication now pay 1070 regardless of status?

I have already been though all of this, but I am mentoring a gentleman who is trying to understand the fees he will encounter so as to plan for them. As he expects to file his I-485 after the change occurs, clarity on this issue would be quite helpful.

OK I now find that there is language in the actual corrected federal rule to protect the concept of the discount. But I can't find the fee as it was not published in the setting of fees.

In the proposed rule, USCIS unintentionally replaced the word

``or'' in the fee for an Application to Register Permanent Residence or

Adjust Status, Form I-485, with ``and'' in an attempt to simplify the

language in current 8 CFR 103.7(b)(1). Proposed 8 CFR

103.7(b)(1)(U)(2). A discounted fee has previously been provided for ...

and has restored that language to the regulatory text in this

final rule. New 8 CFR 103.7(b)(1)(U)(2)

The code says this for filing K2 children of the I-485:

(1) $985 for an applicant 14 years of age or older; or

(2) $635 for an applicant under the age of 14 years when it is:

(i) Submitted concurrently for adjudication with the Form I-485 of

a parent;
