Hello,

My soon-to-be husban is an American citizen. I'm French, I am thinking of applying for a CR-1 visa. As any French person on the forum done that? How long did it take? Also, were you able to travel?

Sorry, you are now on J1? Do you have to get waiver for 2 years residence requirement?

Are you currently in the USA? If so, you won;t be applying for a visa, but for AOS.

Or do you plan to return/are you currently in France?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I agree, the most logical would be to get married in the US while still legal and file an AOS.

This is what I did, and it looks like it's working but I didn't have to apply for a waiver. Is there a big chance that the waiver gets rejected?

2007: Buenos Aires

2008: New York

2009: New York, Paris

03/12/2010: Came to Chicago under J1

09/14/2010: Got married!

09/16/2010: Sent AOS application, I-130, I-131 and I-765

09/24/2010: NOA1

09/27/2010: I-485 touched

11/18/2010: I-131 approved

11/19/2010: Biometrics

02/09/2011: Green Card interview

Mid Feb 2011: Green Card received!

If you are in the US, then you can get married and stay here. You will need to get your home residency requirement waived first. VJ member John & Noemy just went through the same thing, maybe pm him. After that, you will for adjustment of Status (AOS). It will take about 3-4 months. You have to stay here while that is processing until you get your temporary travel papers which take 3 months. That is like insurance in case the GC itself takes a long time. Here is the guide. Good luck!

If you are speaking of the 2 year home resident requirement, I have seen some waived and some denied. It all depends on the circumstances your J1 was under.
