Hello everyone,

Im here on a k1 visa &we jus got married a few weeks ago. I sent my AOS, EAD & AP application vis USPS on 1st October & gt a delivery confirmation from USPS that it reached the Chicago Lockbox on 2nd October.

We still havent heard from the USCIS & our cheque hasnt been cashed either. Im worried because my I-94 will expire on 21st October and I still have not got any NOA's from the USCIS. Will I be out of status if i still dont receive anything from them by 21st October ? And If a do go out of status, is there any other procedure that i will have to follow ?

I know i might be freaking out for no reason. But I cant help but be worried. All these procedures are really stressful :( Please help if ayone knows anything about delays or non recepits from the USCIS.

Thank you in advance,

Minty.

You'll be ok once you have the NOA1 in your hand; as I understand it, it will help "stop the clock" on your I-94 and you can breathe easy until you have your GC in hand. It usually takes 1 to 2 weeks to receive the NOA1 from the time the USCIS receives your application package, so give it a few more days...today is a federal holiday too, so you'll have a bit of a delay.

When you receive your NOA1, refrain from making any trips outside the U.S. until you have your AP...exiting the US prematurely without an AP will result in the USCIS thinking you have abandoned your AOS application, and you guys would have to re-start the process as a CR1.

Hi, have this post transferred to the correct forum. You should be posting on adjustment of status from family-based visa. Also, try to post on the march aos filers thread, you will see that you are not alone in this situation. :)

My Journey:

We met through a study-abroad program in Shanghai, China in August of 2009

We got engaged March of 2010

I received my K1 VISA in 6 months (June-December 2010)

We were married 04/02/2011
I received my conditional 2-year greencard (AOS) in 2.5 months with no interview (April-June 2011)

Our son was born 02/03/2013

I received my masters degree in Speech-Language Pathology 04/17/2013

I received my 10-year greencard (ROC) in 3 months with no interview (March-June 2013)

My husband returned from deployment 06/20/2013

My naturalization journey took 4 months (April-August 2014)

I became a US citizen on 08/01/2014

Received passport in 3 weeks (regular processing)
