Ukraine K-1 initial denial - next steps to fix

Whether someone is dissapointed or not with the CHOICE of their mate has NOTHING WHATEVER to do with whether a visa should be issued or not. Period. Every American has a RIGHT to be completely disappointed with their choice of a spouse and the US government should have nothing to say about it. Nothing.

You do not and should not have to "prove your relationship" whatever that means. You should demonstrate that your relationship is not for the purpose of avoiding immigration laws. If the matter of language were an issue it would be a stated requirement at all consulates. It is not. It is generally not even asked about in Russia or Ukraine, for example. The reason it is asked about anywhere is because those countries are full of frauds or terrorists that would love to destroy our country. One could simply say it would be "common sense" to stop issuing visas to anyone from those countries at all. Ukraine and Russia are full of fraudulent women but they don't really want to come to the USA so they never show up at the consulates. I couldn't care less if you send all your money to someone defrauding you. A fool and his money are soon parted anyway...get it over with.

No one SHOULD care about your emotions. The process is a matter of determining that your spouse/fiancee is not...

1. A threat to the security of the United States

2. Trying to avoid normal immigration processes with the accelerated family visa proces

3. That the person will not become a public charge

That's it. "Common sense" not needed, not wanted. Stay the ** out of my business! You start to apply this BS and all sorts of people will line up to add their own "common sense" to the process. The government should not have any further judgement on my choice of spouse than they do if I marry the girl next door. Their concern should be the basic one of if they ALLOW her in the country. Once they determine she is allowed in the country...stay out of it. Age, religion, language etc have nothing to do with it.

I do not care if you can communicate with your wife. I do not care if your marriage is successful. I do not care if she is trying to take advantage of you or what her reasons or your reasons are. If you are marrying her because she is a HOT piece of @ss and gives you good sex whenever you want and she is marrying you because she wants to improve her living standard and have her own car and she is willing to ** your brains out to get it...then have at it and have a good life! Be happy! I couldn't possibly care less if you can have a conversation over dinner. No one should.

DO NOT open the door for subjective judgement of our relationships. You WILL NOT be happy with how others judge your relationship.

like peoples common sense matters to the government or the process.

you calling me racist,was as ridiculous as it would have been if someone said :" anyone who ever said a big age difference raised red flags is biased and racist." because they are both equally just as irrelevant to my point.

You could have called me naive or immature or ignorance and it would have been correct,after all im only 20 and there is a lot i dont know,but you thinking you can play the racist card with a minority is just flat out ignorant.

having said that you are entitled to your opinion and since you dont even seem to SEE my posts,im gonna leave it at that

Gary, I agree with the general idea of your post but I definitely did a double take on this part. My first reading was that you were claiming no one should have a conversation over dinner.

Not at all. Alla and I eat dinner together every night. Even if she has a late class I wait to eat until we are together and have great chats, but I don't care if anyone else does and I don;t care if they can even speak the same language. None of my concern at all. I also have no concern whether or niot some else's relationship is "successful" or not.

"Unsuccessful" is NOT the same as "fraudulent".

How many of us would even be married at all to our present spouses if we had to "convince" someone it was "common sense" to marry them?

We both had to convince ourselves that it made sense first. I was a hard-sell :lol:

I didn't really want to get married. If they would've had a "girlfriend" visa I would've opted for that.

As a special addendum to those who replied earlier:

FYI I'm going to China this Thursday to meet with a lady who I was chatting with off and on since March of last year - chatting with on a lighter basis. She has a cousin here, and I was introduced to her existence via a friend who brought his wife over from China. I've been to her cousins house three times, two of which were within the last six weeks.

I have never met the girl in China before in person.

On December 25 I had an epiphany and decided to move forward with going to meet this woman in China.

She's an English teacher at a vocational school. I'll attach some photos.

My only concern at this point is on a new I-129F for her, if we go that route, I must list that I had a previous application. If I file a new I-129F for this Chinese woman, on that particular line item I plan to note on an attached page that the embassy interview for the previous petition never took place and that I asked that the previous petition be canceled.

I've heard that the consulate in Guangzhou often issues denials perhaps more than Kiev does.

One key positive point is that this woman in China seems a lot more stable and normal than the woman I was pursuing in Odessa. And she has more potential ready to go friends here who she can talk with easily.

It's very true that I was in a fog in the past, and I was in denial. I think the fog is now clearing.

After the Ukraine betrayal I did not know if I wanted to pursue another overseas relationship and working to bring someone over. But on Christmas I decided to take the plunge. So we're having our first meeting this week.

She seems very hopeful and much more genuine, with a lot more healthy ties both in China and here.

If you have some special comments about how to deal with the previous petition that I canceled and for which no interview took place let me know, so that I have a good chance with the new petition if we decide to proceed.

If the previous petition was approved, regardless of whether you had a visa issued or not, you will need to include a waiver with any other petition submitted within to years. This is just a letter explaining the circumstances and specifically requesting a waiver be granted.

Be aware China is considered a high fraud consualte and you need to study up on it in order to be successful. I know that being introduced by a family member or friend in the USA is considered a BIG red flag by the Chinese consulate.

Be sure to read up in the China sub-forum.
