Timeline

After one year and three months my I-130 and I-129f has been reaffirmed. THANK GOD!!! It is being sent back to the department of state for action. I'm so excited.

I also book me and my daughter's flight to Samoa. We will be there all of January, and I will be having a church wedding with his family....and I will be getting my malu tattoo and his pe'a tattoo to intiate me into the tribe. I feel blessed.

If I could be anything, I would be a tear.

Lol Yes the 6 lbs of evidence paid off, whether they actually read it all, or were just intimidated by it....either way it work. The case is reaffirmed and next stop is NVC. We are no where near the end because we will need a waiver also, but this is a milestone nonetheless. I could have been denied completely which would have been devastating...we've just put too much effort in to lose at this stage in the game.

After two years in a long distance marriage relationship, I have a new found appreciation to all those couples who are succeeding against all odds. Good luck to all of those who have been denied at interview and are now going through this tourture.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

If you don't mind sharing what kind of inadmissability are you dealing with? (reason for the waiver) I hate you are going through this but the good news is, if you put together 6lbs of stuff for the reaffirm process, you now know the drill for the waiver evidence.

Their allegations included but not limited to: Non-Bonifide relationship, he had multiple identifications and has lived in multiple states in the US, his id pictures dont look alike, he used different signatures on his id/social/passport, he was previously married in the US and gained conditional residency with that woman...and while he was still married he was living with another woman who he fathered three children with. They also accused him of being married to his children's mother...making our marriage unlawful. They thought he was still in the US and I was trying to bring a relative over under his name. He overstayed his conditional residency (never filed to lift the conditions)for two years and he left the country two weeks after we were married. The list literally goes on....

So you can imagine why our binder weighed more than 6 pounds. Our case was re-affirmed and every allegation was dealt with besides the overstay which we will deal with in the waiver.

Well if they re-affirmed you must have done a good job on the bona-fides. I think given his Immigration history, the real challenge with the waiver will along with the establishment of hardship, the exercise of discretion. I would be working on affadavit's of third parties demonstrating this guy is good character and good father ..that type of thing along with hardship evidence. Also reading every appeal decision you can get your hands on and seeing what they use in this type of case reasons for denial to make sure you cover every base .
