Timeline

I am watching my fiance's visa like a hawk. I am having nothing but trouble getting her here. Any words of advice or encouragement would be helpful.

I contacted a Visa Attorney in January. Papers sent February. Never received an NOA1 because he never sent it. Received a RFE in July. Now I am being sent another RFE (August 14th) and I am waiting to see what the attorney forgot.

I have contacted all my senators and congressmen and they have sent it an Expedite for processing. The congressmen have not received a reply. He and his staff had no idea how bad USCIS had become, and too are powerless. I have been to my local office, and I am considering going to CSC and personally flying the information to VSC. This is getting beyond ridiculous when others are getting approved in 50 days. If I would have reapplied in May she would be here now.

By the way... she is due in January. And she is ordered to bed rest.

What can I do?

Novosibirsk to Minneapolis

Waiting for Interview, and to be together.

Saw my smart beautiful wife to be, and my baby girl on July 3rd, 2006

We expected her to be in Minneapolis on May 6th, 2006

Arrived October 27th

Married December 3rd

Baby girl born on December 29th

Started paperwork on AOS April 1st

Dude, you are getting a 2nd RFE, this can actually expedite your case. Take it from me (look into my timeline), you get the RFE, turn it around quickly and Whammo, approval.

When you send the RFE evidence back, send it USPS express. On the front and back of the USPS provided document Envelope, write the following: ATTN:RFE in red marker. This is the information on the RFE envelope supplied by CSC. It will then move through CSC like a madman!!!

2 days after CSC acknowledged my RFE, approved. Try it. Plan for success!!!

In addition to writing RFE on the envelope, you could also include the NOA1 number (your receipt number).

I've just checked what's the criteria to expedite processes on the USCIS site (below).

All expedite requests are reviewed on a case-by-case basis, and are granted at the discretion of the Service Center Director. The criteria are as follows:

* Severe financial loss to company or individual.

* Extreme emergent situation.

* Humanitarian situation.

* Nonprofit status of requesting organization in furtherance of the cultural and social interests of the United States.

* Department of Defense or National Interest Situation (Note: Request must come from official United States Government entity and state that delay will be detrimental to our Government.)

* USCIS error.

* Compelling interest of USCIS.

If a response to the expedite request is not received within 72 hours, the request is denied. The application or petition will then undergo normal processing.

Also, if you have a straightforward case and you think your lawyer has caused more harm than done any good, why not fire him/her?

Other VJers have gotten good help from congressmen/senator. Dwar49's case comes to mind. You can try and PM him for more info.

I only offer advice - not even legal. Just the plain and simple kind.

I think an expedite is unlikely - waitingincolo can't even get his case expedited even though 3 months of his delay was due to USCIS error and it was documented. And while Dwar did get help from his congressman's office, he is one of the only cases that comes to mind where his approval may have been helped along by the congressman. In my experience with my senators and congressmen, they have voiced their concern and shock at the situation at CSC, but they have said they can't do anything to change it.

I hope the RFE reply will fill in the final piece and your approval will come right after that. In the meantime, I hope you not only fired that attorney but got some kind of a refund due to negligence.

It looks as if, once you are approved, it shouldn't take more than three months to the Moscow interview date.

I dont mean to be negative or unsympathetic. Believe me, I understand your frustration. Many have heard me vent mine on here. My question is, if it gets expediated and she is on bedrest, is it a good idea to make the journey? Especially as she gets closer to the due date.

I guess what I am saying is being expediated isnt likely, but maybe looking at it that she is safer not travelling may help ease some of the frustration. Maybe everything will work out timingwise so she can come when it is best and safe for her.....

I agree with "William33" that you should probably find another lawyer or handle the case yourself from here on out. Heck this process causes enough drama and you lawyer has created another level a chaos. Good luck and please follow the above advice with your RFE... it does work!!!

I wish I had some advice for you that I could also use! Unless I have missed another string I'm not entirely sure why this case should be expedited. According to your timelime you received an NOA1 in March. So it seems that you, too, have been touched by the IMBRA fairy. Filing in May probably wouldn't have helped you. I did and there's no NOA2 in sight.

Filing Fee: $170

Overnight fee: $12.50

Waiting an undefined amount of time for the CSC to approve your application while they provide no explanation or information to the petitioner, the attorney, or even the Congressman, about how the process works, why there are delays, etc, etc, etc..... PRICELESS!!!! :huh:

4.20.2006 - Engaged

5.15.2006 - Lawyer submits I-129F to CSC (via overnight)

5.17.2006 - NOA1

5.30.2006 - Receipt acknowledged by CSC

Don't just open your mouth and prove yourself a fool....put it in writing.

It gets harder the more you know. Because the more you find out, the uglier everything seems.
