We just found out on Thursday (October 7th) that both our petitions were approved at the CSC (we went down the K3 path). 129f had been sitting for 84 days and 130 had been sitting for 114 days. We are very excited.

So, I know the routine by now about 129f's being canceled in favor of the i130 and the CR1 at the NVC. I've read on a few other forums that you can call the NVC and request they continue with the 129f and the K3. We'd prefer that route because my wife isn't going to work when she gets here and the extra fees aren't a major issue. Also, she already has a SS# from a previous J1 visa visit so we can get her a bank account. I just want her here NOW. So, is there any truth to this? Can I call the NVC this week and tell them we prefer if they go ahead and send the 129f to Dublin so we can get a K3? The thought of spending another couple of months in the NVC while I send in affidavits of support etc etc makes me unhappy!

The same thing happened to me and my husband, and they would not allow me to keep the I-129F, because it was approved the same time as the I-130. We have to wait for the CR1 process now. Believe me, if there was a way to get my husband here earlier, I would have found it.

3/07/11 - IV payment status "PAID"

3/08/11 - AOS and IV packet sent

3/22/11 - AOS in the system and reviewed that triggered false RFE for IV packet

3/28/11 - DS-230 in the system and SIF

3/29/11 - Case Completed at NVC

4/13/11 - Interview date assigned

5/17/11 - Interview- Approved

5/18/11 - Passport & Visa Picked up from VFS Delhi

Just updated our timeline...hope we hear from the NVC asap. Forgot today was a federal holiday so no notices in the mail today!

Thanks. Did u expedite your case because that is so fast even people who only filed I-130 are waiting 150+ days. Everybody on this forum keep saying how filing K3 will slow down the petition but that is not the case with you. That's why i am asking.

Of course it's true you can ask. I doubt your request will be honored but no harm in trying. I'd advise being prepared to take the CR1 route anyway as that's the most likely outcome. Please report back on how your request is handled.

Yeah I am wandering also,,cuase we are not thinking we will see an Noa2 till the end of Oct or early Nov..Our I-130 Noa1 is June 1st 2010 and our I-129f June 17th, 2010...

No expediting that I know of. We just submitted all our standard paperwork through our lawyer.

If the 129f has NO purpose anymore why don't they just withdraw it and not allow anyone to file it anymore??

Because the two "theys" (Departments of State and Homeland Security) are separate agencies with a long-standing rivalry. If it were on "they" perhaps there would be a sensible result.

Spoke to NVC tonight. We are IR1 bound...she said the request to continue with K3/129F will NOT be honored. She said not to worry, IR1 will come through quickly as long as we send the forms and fees ASAP. I'm hoping for Xmas or sooner for a Dublin interview date!

If you are eligible for IR-1, than that is definitely the better route than K-3. No lifting of conditions.

(I'm going for the IR-1 and blowing off the K-3. Even if it takes an extra couple months, it's worth it to not have to deal with USCIS again)

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

The IR1 visa is definitely better than any other visa out there, so it's a blessing in disguise. Keep in mind that in order to get a December interview, you will have to have every document and payment ready to send the NVC so they can complete your case before the middle of November. If they complete it after this date, you will most likely get a January interview.
