Immigration is too confusing! I JUST WANT MY I-94

HELP!

I came to the USA as a vistor, however I have met someone and want to stay. I do not want to marry just to stay in a country and I have tried to find another way. After 7 months of searching I found out that I can apply for a social security number as long as Homeland Security assists me and allows me to. BUT I need my I-94 to apply for anything I need. I was not given one on the Canadian side of the border nor have a gotten one since I have been here. My VISA expires March 19th 2011, my orignal flight back home as March 29th 2010, however I called Homeland security to let them know I would be staying until my VISA expired or until I could find a way to get a long term VISA. They had told me that my VISA is good for 365 days. However everytime I call homeland security about obtaining my I-94 document they direct me to US immigration, but there is nothing they can do for me there words are "since you are already here it will be hard for you to get a VISA (with the exception of STUDENT or Marriage). I am not sure if anyone has experienced a similiar problem but if anyone could lead me in the right direction it would be highly apprechiated! Thanks!!

I have never heard of DHS "helping" you get a SSN. You are other authorised to stay in the US until the date on the stamp they put in your passport when you arrived. As a Canadian you DO NO have an I-94.

Your best bet at staying, if marriage is off the cards, would be to leave the country and obtain a Visa such as a working or student visa and then re-entering the US. You could investigate employment options whilst you are here in the US, and also look into schools.

It is important to remember that if you exceed the "leave by" date in your passport (not your visa, you PASSPORT will have a stamp from when you entered and a leave date (usually 6 months from when you arrived)) you will be subject to a ban on leaving the US.. the length of the ban depends on how long you have overstayed.. it will be either a 3 or 10 year ban.

I think you are confused....

- Visas are to enter a country- you are already here.

- A SSN doesn't give you the right to work or stay here.

- Visitor's visas last for a maximum of 6 months, but can be extended. However, Canadians do not need a visa (are you a Canadian citizen?).

- You cannot just stay in the USA, it doesn't work that way. You can apply for AOS (adjustment of status) to get a greencard only if you have a valid reason, such as being married to a US citizen.

- Your other option, if you have not overstayed too long, is to go back home and apply for a TN visa (assuming you are a Canadian citizen, again).

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

You obvioulsy cannot stay legally in the US. I think you are confused. SSN are not for authorized work or stay in the US and DHS does not help you get one.

Also, you don't just simply let DSH know you are staying, you must apply for a visa extenstion, have you done this?

Your visa may be good for 1 year, but your authorized stay in the US is LONG over (I assume because Canadians are given a max of 180 days to stay)

Are you a Canadian citizen?

that happened a loooong time ago, in the 70's, I'm not sure if the 80's when tourists were able to get a SS number just by having a valid i94, but not anymore.

Canadians anyway don't have an i94, but for other countries, as long as they hadn't overstayed their 6 months, they could go to a SS office and get a SSN not authorized to work, the same with student visas, they could get a SSN not valid for work, but not anymore.
