Hi everyone! I am filing for a K-1 visa. My fiance already received the interview package and our interview date is on November 29, 2010. I noticed that for that date the NOA 2 (form I-797) will be expired. Do I have to ask for an extension? If yes, to who, and where do I have to request it? or do they extend it automatically? I appreciate your help, thanks!

You're fine. The petition is always approved for a set period of time, but the whole application is seldom completed within that time frame. The petition will be automatically re-validated by the Consulate, especially as they have already scheduled an interview. You don't need to do anything.

If you're really worried about it, the place to contact is the consulate you will be interviewing at. They will almost certainly extend your petition automatically, but you can ask for an extension yourself, if you wish. Just contact the consulate (I know this is easier said than done for some consulates), give them your consulate case number (from your Packet 3/4), state the expiration date of your I-129F petition approval, and formally request that the petition be extended to encompass your interview date and any possible extra processing. They will virtually certainly grant that, and the worst case scenario is they think you're a bit of a worrywart. :)

Looking at your timeline makes me very happy for you, yet very jealous for myself! I can only hope to make such speedy progress... You are really lucky and I hope your good luck continues to a good interview and a quick visa approval!

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

You only just asked yesterday, you would have eventually gotten a response. Try to get your questions in in the morning and afternoon EST, there seems to be the most activity on the boards at that point.

Automatic extension; your petition is in the hands of the Embassy now and not USCIS.
