NVC to USCIS....

Hi

NVC informed me that the denied petition by the US Embassy is received by them and sent to the USCIS. I got couple of questions.

1. How long the USCIS will take to process and contact me to let me know how to appeal?

2.Since the petition expires on NOV 20, I got only few days to appeal. So if the petition expires, do I have the chance to appeal or I will be runnig out of time?

Since your petition is going to CSC it's unlikely you'll get a chance to appeal, at least not now. CSC usually just allows the petition to expire, and sends you a letter telling you that the petition has been closed because it expired, and you're free to file another petition. This doesn't take long - a matter of weeks, usually, before you get the notice.

The CSC has been using a new tactic lately. They send the letter telling the petitioner that the petition has expired and they are free to file another petition. After the petitioner files another petition they send a Notice Of Intent to Deny (NOID), citing the reasons the CO denied the visa from the previous petition. If this happens then this will be your chance to rebut the consular officer's accusations.
