Are these things allowed?

1) USC and applicant both move to USA upon POE (with visa in hand). However, applicant comes back to Canada for a few more months to wrap up business, etc?

In other words, is it allowed to say "we are going to make POE during x-mas holidays" but then me (the applicant/canadian) will come back to Canada for a few more months so that I can finish up and resign from my job etc?

Or do you have to resign (assuming your company cannot transfer you) your job prior to doing POE?

2) What about if we schedule POE in say February or March, but then decide to take a XMAS trip to the USA. Is my x-mas entry into USA automatically going to turn into a POE (by customs/immigration officers who see my entry).

Again, am I allowed to make POE and then turn around and come back to Canada to finish up unfinished business (or even last few weeks/months of a job)?

at POE, ya gets a stamp in the passport that validates the visa to be used as a temporary I-551 document, a temporary green card, for up to 1 year.

Technically, could turn around, same day, after receiving that stamp, and leave the USA, no worries for returning.

So with that said, you can plan anything you want -

but

be certain - when coming through the POE -

that CBP has the 'current address' for the USCitizen Spouse's USA domicile -

if it's changed since filing the DS-230,

and if you didn't update it on interview day

you've GOT ONE SHOT to fix it

otherwise, expect yer green card to 'get lost' inside the USCIS system.

as to 'when to go through POE' - it depends on the visa validity duration, printed in the visa. Usually, you'll have 6 months from date of issuance, but it just depends. Montreal is so squirrely these days, you really need to read whats printed on the visa, then make yer plans based on THOSE PRINTED DATES.

Darnell, I didn't quite understand your paragraph above... Can you explain and/or rephrase it?

Where/when is this "one shot to fix it" happening and what are its implications? Who is caring about this address and why does it need to be changed etc? Sorry I am confused by your paragraph above :-?

Also, given the fact that I wish to make POE and then come back for a few months to wrap-up work, WHAT SHOULD I state during my interview as "the date when I will be doing my POE" (IF THEY ask that question during the interview that is). Should I give the x-mas date or should I give the February date?

If I give the x-mas date, is the visa interviewer being given the impression that "that is my final move"?

So basically I am asking what POE date shall I declare (if I am required to declare) during the interview?

There are 3 'capture points' to get it right -

1. DS-230 form

2. interview day, change with Visa Officer

3. POE day, change with CBP Goon.

POE date is 'the last chance' you have, to 'get it right', for the address.

re: your dates, sorry, I've no real input, at this point. There is only ONE POE Date. Once you've done it, it's never called that again.
