I have applied for my Mother and Father for green card. Before filing I-130 I asked a attorney that I have brother who is 16 years old, and it is really hard for my parents to leave him alone there. According to her, he (brother) CAN NOT come with parents as minor. I got some other information from other friends, that he applied for his sister, and she came to us with her all family (husband and minor kids).

Please help if you know what is the process for Parent's with minor to get green card.

Your lawyer is correct - your brother can't come with the parents. Parents can come to the US, activate their visa and then apply for the child - wait time is couple of years. No instant visa number available in that category.

Your friend had a different petition - FB4 petition (sibling of USC) takes around 9-20 years depending on the country where the beneficiary is from. Once approved, sibling can bring their spouse and minor children.

Your friend had a different petition - FB4 petition (sibling of USC) takes around 9-20 years depending on the country where the beneficiary is from. Once approved, sibling can bring their spouse and minor children.

spouses and minor children of siblings are derivatives of the siblings petition. the sibling can come with spouse and unmarried minor children.

parents are separate petitions, and so are siblings. siblings aren't derivatives of parents. you have to file separate petition for siblings.

look at my time line /signature below. I applied for mom/dad.. i have a 14 y/o brother and he's unable to come along... it's a every country thing sorry. They can come here apply for him and go back for 6 months.

The wait time isnt a couple of years. Now the USCIS takes 5 months to process such applications and the NVC is currently working on those who filed April 1, 2010 or before (so 6 months back). With that in mind... he can expect the process for his little brother be 8-13 months.

Or apply for Brother and when current they can all come together.
