my k1 visa interview took place 12 months ago in Islamabad embassy, Today i made a phone to call U.s embassy Islamabad they says we know you get married we are sending your case back, file case again and provide shaadi documents, it will take 2 weeks to arrive letter to your fiancée.

To be honest not being married hence no marriage documents.

Arguing will just waste of time with embassy thought they dun have any documentation prof, and how can they have proof when no such marriage took place.

i have requested to my fiancée visit here in Pakistan after marriage we will file shadi visa again. can you please guide me how can file shadi visa here in Islamabad embassy ? any reference document ?

or guide me what to do.

Even if you decide to accept the denial and re-file after getting married, I'd look closer into why they think you are married, as this could cause issues with any future visas. When do they say you got married? Did you have a big engagement ceremony? Did you call eachother husband and wife in emails? Is there someone who could have given false information to COs to stop you from getting the visa?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

did you have a formal engagement? if so are those the pictures that you used for the embassy? sometimes the embassy confuses those with marriage!.........getting married right now will not fix the issue what you need to do is prove that there was no marriage......some how they have gotten information that you are married either from mistaking the engagement pics to be wedding photos or from talking to one of your family members or something the key is finding out why they came to this conclusion.......

yes my Dad, embassy called my home and said they made my dady to understand that without their acknowledge i have done shaadi.

what should i do to prove that we haven't done shaadi yet. will they belive on word of mouth ?

this happened to someone else about a year ago i cant remember who it was .....but i think if you post this in the forum for Islamabad embassy you will get better information than you can get in posting just in the k-1 forum.......this is just my opinion but your s/o needs to get her congressman and senators involved in this fast.......try getting written statements from your family...imam.......and your court that there is NO registered marriage. I dont know if that will work but its a starting point.........I would also get a hold of the embassy again and try to talk to someone there that will allow you to speak and try to make them understand ask them what you can submit for proof that this is not the case at all.

you should also have ur s/o send an email/call what ever can be done on her side to find out what they will accept as proof that there is no marriage...Islamabad embassy is one of the more difficult ones our family will make dua and prayers for you and your s/o i wish i had more information that could help you

I would spend some money on a consult with someone like Marc Ellis. He is very good at shady embassy practices and can tell you what you best path is. Gather as much data as you can before you talk to him. Also have your fiance get in touch with her congressman and have then request a review by the head CO.

This will not be over quickly. You will not enjoy this.

If Embassy says they are sending the petition back to USA, back to USCIS, then you have no recourse today -

there is nothing to do to HOLD the casefile at the Embassy, nothing that YOU can do.

HOWEVER -

this sounds like massive mess -

and

IMO

you need a Senator's office in USA, Immigration Liason Staffer Human, to sort it out with the Embassy -

so

talk with yer USCitizen Fiance today - tell him/her to get an ILS with the US Senator's office, now - get/sign (her) the release forms today, and be prepped to 'run' a Congressional Inquiry on Tuesday.

or

you were told verbally or via a 221g document,

to submit more evidence - and NOW you can submit 'more evidence'.

It's hard to know - I'm guessing you not talk with USCitizen Worker, US Embassy Consular Officer, but instead spoke with 'local worker', a Pakistanian, and they've screwed you over.

it's one thing 'to try'

it's another thing to 'do it properly'.

No try, Only Do.

today's a new day, you have new info, you need a new 'do' .

yes talked to local local Pakistani lady, they haven't send 221g document to me or my fiancée yet, she told me verbally, said we are sending case back to U.S, will send latter to your fiancée about it.

this sounds like 'procedural error' at the embassy

and if you want a visa soon,

yer fiance needs to do stuff with a Senator's office, today.

IMO, if nothing is done today, by yer lass -

then this procedural error will not be remedied next week

and the casefile will be sent back to USCIS

and then !!!!

Expect a 4 to 11 month wait for USCIS to send her stuff via postal mail.
