AOS Application and Marriage Certificate

I am hoping that someone would be able to help me with this. I am getting married on September 10, and my I-94 expires on September 29. I was planning to send my AOS application right away, but when we went to get our marriage license yesterday, we were told that it will take 2-3 weeks for our info to be processed when we mail it after the wedding. I am concerned that it will not be done before 29th. I know that we have to get married before I94 expires, but am not sure if I also have to file AOS by that day?

Senka,

Congratulations on setting the date. From what I know, there is no set period for filing your AOS. Yes you should get married within 90 days but when you file after that is up to you. If you get your package ready, you could file the day you receive your marriage licence.

I don't know why it takes 2-3 weeks to get your marriage cert., it takes 2 days in Chicago.

That helps, I was worried about missing the deadline and complicating the process even more. I am not sure why they said it takes them that long to process marriage info, perhaps they are backed up in California.

Its really not going to cha change anything so dont worry about it as long as you married within 90 days.

If you are that much in a rush, some county clerks allow you to bring it to their office yourself and they will process it for you then and there. But this also needs to be discussed with your officiant.

Congratulations on the wedding date! As for when the I-94 expires, I wouldn't worry too much about that...enjoy your wedding and file AOS right after if that's what you want. We mailed our AOS stuff off 10 days after we got married. As long as you are married within the 90 day period then you're fine.

The marriage certificate shouldn't take that long, even by mail but my husband and I were able to take ours directly to the Probate Court office (yes...the Probate Court office...for anyone questioning) and the clerk processed it right then and there, although we had to pay extra for an additional certified copy of our license to mail in our AOS application.

Thanks for the nice wishes! I asked them if we can bring our documents in person to process it right after the wedding, and they said that it is done in Santa Ana, which is a different city, and even if we went there, they dont' quarantee that it would be done right away.

As long as I am o.k. with filing AOS after my I94 expires, I won't worry too much about that. There is still so much details to take care of for the wedding which is coming up in exactly three weeks.

Don't worry, you'll be fine. My husband & I filed for AOS two months after his I-94 expired, and we were approved with no problems.
