My mom became a U.S. Citizen when I was 16 years old... how come I'm not a U.S. Citizen??

Sorry to keep replying on your post. I just wanted to add that when we first came in 1988, we didn't stay for long. We came back and forth from the U.S. to the Philippines a lot (I know just from pictures and stories), and then when we came back in Dec. of 1994, that's when we stayed in the U.S. and never went back to the Philippines. Just wanted to clarify that! :blush:

Okay then. If you were an adult your "overstay" would have started from the end of the last authorised stay in the US. So, if you arrived Dec 1994, how long were you admitted for? What does the stamp in your passport say for when you were supposed to leave? You would calculate time from that date.

In either event as a minor you would not have had the overstay held against you until you were 18 and 6 months old. So TECHNICALLY you've only overstayed from when you turned that age. If it's been less than 180 days since you turned 18 and 6 months then technically you could have still left the US and not incurred a ban. You could then re-enter (if they'd let you) banless. If it's been more than 180 days but less than 1 year then you'll get a 3 year ban, more than 1 year a 10 year ban.

This is all a moot point anyway because you're going through the AOS process now. Your overstay will be forgiven once your GC is approved. DO NOT leave the country or your AOS will be abandoned. I just wrote this for other peoples interest.

Huh, how ironic that you say that... I actually bought HER a brand new lexus from the money I got from a car accident when I was 19 :wacko: (theres a picture after the accident of my mom and I on my photobucket..link is at the bottom) I guess I'm just one of those daughters who love their mama's no matter whattt... my husband thought I was crazy too. :hehe:
