Hi everyone

I was married in the Philippines on Dec. 11th 2009, and lived there with my wife and her 3 young children. Now I want to patition them to the USA. I see a few options of visa types. I am hopeing to find someone that has already been down this road for advice and guidence. The 3 kids have bith records as illagetimate so not fathers to deal with. My wife has never been married tilll now to me. I only receive disability income from the TSA and so I will also need a co-sponsor. I want to use the IR1 and IR2 for my wife and kids is this the best? i would like her to be able to work as soon as she arrives.

So the first step would be to find co-sponsor right? after that fill out the forms (not sure of what is needed) for both me and the co-sponsor. I know i need to fill out the I-130 and maybe the I-129f? then submit all to the uscis office for my state along with all fees, right? like I said I really need to chat with someone that has been there before.

Thanks everyone......Rod, Jube Joy, Alexandra, Heaven and Yanis Justin....Brown family

Forget the K3, it is obsolete. Plus with the IR-1, she and the kids will get ten year greencards upon entry to the USA. If you have been residing legally in the Philipines since your marriage, you can file DCF (direct consular filing), directly with the embassy rather than deal with US offices. This is much faster!

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

The type of Visa would be considered a CR-1 because you have been married less then 2 years. If you don't meet the income guidelines then yes you would need to find a co-sponsor. The way I did this was combine my income with a family members income. That form would be the i-864a but that type of co-sponsor would need to reside in the same house as you. Send me a message if you need help, I will personally help you out if i can. I have some times on my hands until the new job starts. :) Take care

if you have resided in PI for 6 months or more, can file the I-130 'collection' to US Embassy/Manila/IV Unit.

IF you wish to file, instead, to the lockbox address in Chicago - hey - that's do-able to.

One I-130 for each person (1 on her, 3 more for the kids) - 4 sets o fees.

and

The K-3 isn't really available anymore - see/read/review http://www.visajourney.com/news/2010/02/07/department-of-state-to-close-k-3-visas-if-i-129f-and-i-130-petitions-approved-and-received-together/

Bob's given you the link for the I-130 Guide - but bear in mind - any instructions there about the K-3 - IGNORE THEM

If you choose to file I-130's to US Embassy/Manila/IV Unit - wei - that's 'Direct Consular Filing' or DCF - here's 'that' guide --> http://www.visajourney.com/content/dcf

I'm not sure if Manila 'allows' co-sponsers/joint-sponsers for CR-1/CR-2 visas, but it's worth a shot, always.

Rodney - are you a permanent resident of the USA, or a USCitizen ?

Hi

I am us citisen and live my whole life in Wisconsin. I lived in The Philippines for 9 months after my wedding there.

I read the I-130 instuctions and my wife's kids fall into the part of the form for unmarried children under 21 and so no seperate I-130's needed for the 3 kids. I dont think I qualify to file DFC cause i was not philippine resident for the required time as per their guidlines. Any help is very welcome as we want to be together asap. ah - you might want to get another opinion on that, filing 3 I-130's for 3 children, and soonish.

IMO, ya need 3 separate I-130s for the 3 children.

But hey - ask around, get some more input.

*** moving to IR-1/CR-1 forum, for now, for wider exposure, as children (CR-2) are tied to the Spouse (CR-1) case ***

Each child needs a separate I-130 petition; you may file the petition on their behalf as their stepfather. You'd just need to show proof that you married their mom while they were all below 18 years old.

Actually I think the requirement is only 6 months...

If you were going for a K-1 (Fiancee) Visa then you're right but you'll be filing for CR-1 Visa for your wife & CR-2 for each of the kids so you will need 4 each:

I-130 Petition Packet & Filing Fees

I-684 Affidavit of Support (only 1 Fee)

DS-230 Immigrant Visa Application & IV Fees

Medical Exam (about $220 each)

Air 21 Delivery Fee (about 250Php each)

CFO Seminar Certification & Fee

Might not want to sign your posts like this as the Moderators might take it as you asking someone here to co-sponser for you which is a violation of the TOS...
