i-130 approved but i moved abroad

Hi everyone,

I am a US citizen and my wife is an Indian citizen. 5 months ago, after my marriage in India, I filed a i-130 petition for my wife. I was working at a university in california. Just recently I moved to Germany to work at a university for 2 years. I had to go where my work took me. Yesterday, USCIS approved the i-130 and mailed a letter.

So now I am employed in Germany and not in the USA. But all my family is in USA and I consider that my home and I plan to go back after this 2 year project. This is my plan... I don't have a job waiting for me after two years. I don't own any property in the USA. I have always paid my taxes regularly and will continue to do so.

So what options do I have? Is it still possible for my wife to get a greencard now? You may say that she doesn't need a greencard now.. she needs it after 2 years. But no, I would say she needs a greencard now because I plan to visit my family in USA reguarly, especially during the holidays. I would like my wife to visit them too. We are all family now.

if you wish to time her 'arrival in USA' with YOUR arrival in USA -

here's some tips

--you have 1 year to get things done at NVC. Delay, plan accordingly.

--the embassy will take 1 to 3 months before any interview date.

--once the interview date is set, ask The Embassy to delay it by 4 or even 6 months.

--once her visa is approved, she has 6 months to arrive in USA

----

see? 2 years of delay, if you plan ahead. Ultimately, if you delay in this fashion, she'll get granted an IR-1 designation, with a 10 year green card after first arrival in USA (no 2 year stuff for her, no man!)

In the meantime - hey ! is she planning to move to Germany to live with you? Strongly suggest she do that - as it 'helps with evidence' for interview day.
