Processing time for i-485 under 245i

Hi, I like to know how long it usually takes to process an i-485 under 245i.

this is my timeline so far,

08/06/2010 - Mailed to Chicago office Express Mail (i485, i485a, i864, i765, i131 etc.)

08/09/2010 - Received by Chicago USCIS Chicago Express.

08/18/2010 - Checks cashed

08/21/2010 - NOA's received in the mail

08/30/2010 - Biometrics appointment letter received (for 9/22)

09/22/2010 - Had biometrics done

09/27/2010 - Email/txt about EAD ordered

10/02/2010 - Received AP approval letters

10/04/2010 - Recevied EAD cards in the mail

10/05/2010 - Applied for SS# at the SSA office

......Waiting for an interview letter, im in NYC.

im actually the derivative, my aunt(USC) petitioned for my dad based on FB4.

QUESTION***

My dad has a record where he was arrested over ten years ago for a dispute at a restaurant(they thought he and his friends were drunk so they added buncha things to the bill and my father refused to pay), however, due to the language barrier and since he was abit intoxicated, he was arrested. He was fingerprinted, paid the fine, and was released. I got his court disposition letter saying everything was dismissed. We gave it to the lawyer so he can mail it with our AOS application as well as an explanation letter.

Now the question is, do you think this is whats holding up the process? Im sure his fingerprints are gonna raise a red flag initially from the FBI name/fingerprint check.

I'm dying to see that interview letter...

i-485 cases take usually 6 months, however, in the case of 245i, it's longer, he said 1 to 2 years long.

how true is this? im crossing my fingers because I can't believe its gonna be another year or 2...ughhhhh

can anyone add their input? Jim?

We don't see too many 245(i) applications here, probably because most people who qualify have filed long ago.

I have also heard that a 245(i) takes longer than a typical AOS. I've also heard that the more time passes since the April, 2001, cutoff date, the longer they take. They don't easily forgive an EWI, and the longer you wait to file under 245(i), the more time the immigrant is residing in the US. They search the law enforcement records over that entire period for evidence of an inadmissible crime. The restaurant incident will probably come up in their investigation, but they'll likely gloss over it. Even if he were convicted, it's not an inadmissible crime. They also closely examine the circumstances of the qualifying immigrant visa petition filed way back when.

If your attorney has experience with 245(i)'s then I'd take him at his word.

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

your case is going pretty quickly, mine in 2004 lasted around 6 months from start to finish. now in the forms you mentioned, I don't see the i693 the medical and vaccination and the G325A. they sent a packet for each and every one of you right?

he didn't need to file the travel document the i131, you cannot leave the country under the 245i law

My USC mom filed for me in 1999, time flys, now I'm a USC

don't worry, it's not true that it will take up to 2 years for the interview.

sorry, i forgot to mention the i693, and the g325a, everything was filed.

it sounds great that it only took 6 months.

someone told me for processes that take more than 4-5 months are qualified for expedited services, is that true?

as for the AP, im aware that I can't leave the country but I think my lawyer filled it out because it was included in the AOS fee's

Can i ask, how your visa priority date was available so quickly? were u in FB1 or 2 category? under 245i correct?

Mine was category F1, unmarried child over 21 of a USC, 5 1/2 years under the 245i.

I don't think that's true. Anyway it doesn't take more than that until the interview.

can you tell me about your interview experience?

I hardly had any questions asked, I look like my mom. family based petions are slightly different than marriage. you can't divorce your family. so as long as you have proof that your parents are who they are, the rest is very easy. the most important thing is the affidavit of support. they'll ask very few questions about your family and if you have a relationship with him.

do you have pictures together? you can bring them. they didn't ask me for them, but I brought them just in case.
