Im 15 can i file for green card?

My mom has a green card but she didnt put me and my sisters name in it so we have no green card. I asked my dad to get me a green card but he said no we dont ned green card. I want to go to college

. I asked my mom to make me a green card but she said ask my dad to make it. Can i aply for green card if im minor? Is my dad lying cause he said i dont need green card if my moms applying for citizen? If both my parents dont want to aply for my green card can i apply by myself or wait till im 18?

I could be wrong, but I believe that if your Mom acquires citizenship before you turn 18, you get your citizenship automatically. You might have to be included on her citizenship application for that to happen though.

As for the rest, we would need to know more about your parent's current statuses to give more concrete information.

I could be wrong, but I believe that if your Mom acquires citizenship before you turn 18, you get your citizenship automatically. You might have to be included on her citizenship application for that to happen though.

As for the rest, we would need to know more about your parent's current statuses to give more concrete information.

that's not true, like I said before, that's if you are a resident and you are a minor if your mom becomes a Citizan then you will automatically be a citizen. but first you have get the GC.

you are a minor, you cannot file for yourself, your mom or dad has to file for you. for proof, you can download the N600 form on the USCIS website and read the instructions. you can show them, and highlight to your mom and dad that they require a copy of your GC for your to become a US Citizen.

Then they might get it, that one of them has to file for you to get your GC.

I gather you are from India, did your mother marry a US citizen? Just wonder how you came here, did you come on a tourist visa? Did they put an I-94 in your passport that limits your stay here?

I am a US citizen that married a woman from another country and also got another daughter in the bargain. I had to petition for my step-daughter with an I-130 form, plus had to fill out another whole bunch of forms for my step daughter so she would have her green card too. She needs that to be here legally. Only I could petition to bring her here, and it doesn't make any difference if she was just born or if she was under 21 years of age. I also gained a step son, I could not petition for him and neither could his mother. His mother had to get her green card first and only then can she petition for him. We are still waiting for the Department of State to contact him for an interview, it is taking years. My step daughter was able to come here immediately because she was under 21 years of age.

We could have just brought her here on a tourist visa and she could have gone to school. The reason for this is that neither grade nor high schools do not want any proof that you have a green card, the only thing they want is more students so they can get more money. But you are correct, if you want to go to college, you cannot go unless you have a green card. My step-daughter is in college now and the very first thing they wanted to see was her green card. But according to the Department of State, you cannot go to any school until you get your green card.

I don't like to say this, but your stepdad is wrong, you do need a green card to be here legally as do your sisters, it is the law of this country. I don't know what to tell you on how you should tell this to your stepdad. But he should have petitioned for you even before you came here.

I answered your question on Yahoo's immigration forum today and was actually the one who referred you to this site to dig deeper into this.

People, her mom has a Green Card, but according to her, she as the daughter doesn't need one. We all know that's not true, so here are two scenarios as I see it:

1) Her mom's Green Card is fake or she doesn't have one, just claims to have one

2) Her mom is pretty clueless.

What I would suggest is to advice the O.P. on how to proceed from here. Help this girl!

Really can't make assumptions, but this is what she said:

Country is shown as India, one assumption is it is her biological father and mother and both are here illegally. Another is her mother is biological, father is a US citizen that only petitioned for her. Or maybe he didn't, yet another assumption.

A not so nice assumption, this is some old big fat guy I good snap his neck in a second laughing his balls off while we are pouring our hearts out to this young helpless girl. But let's assume for the minute this young girl is sincere.

No she cannot apply for a green card, neither as a minor nor as an adult, she needs a step mom or dad or other US citizen to petition for her. Let's see if she comes back with some answers to our questions.

As a minor the only way you can obtain a green card is through family immigration, having an immediate family member petition for you. I am not 100% sure about a student visa for a minor but that would be quite expensive even if possible.

A few questions. Are you currently in the US and if so how? or why did your mom leave you in India?

How did your mother obtain her greencard?

Even as a minor you must have a greencard to live in the US legally as a resident. Perhaps your parents are thinking that because you are a minor you are exempt from this requirement?

What can you remember about how your family got here to the U.S.? Are both your parents Indian citizens? Did your mom marry a US citizen?

Sorry I couldn't really dig deeper into this yesterday night as I was on my way home, dinner on the stove. Let's see what we can do for you.

Fact is, you do NEED a green card, even at age 15. The Green Card, and being a lawful permanent resident (Green Card Holder), is the basis for eventually being able to become a US citizen. If you want to go to college or apply for a job, you'll be asked if you are allowed to work in this country. What they usually want to see is your Green Card and your Social Security card. The least they need to have from you is the number from your social security card.

I understand that this is a sensitive issue, but the first thing we have to find out is:

1) if your mom does indeed have a real Green Card or if she's trying to withhold her legal status from you. (She might do that because she doesn't want you to worry.)

2) when and how you arrived in the US. For that you will need to find your passport and look for a visa to the United States in it.

3) if you have a social security card.

Depending on your findings, we can advice you better, because at this point we don't really know enough to figure out where this will take us. There are so many scenarios, you wouldn't believe it.

One good thing is that you are only 15 years old at this time. That's good because even in the worst case scenario -- and I don't want to think in this direction at this early stage -- you do not accumulate illegal presence. In fact, illegal presence does not start to count for you until 180 days after your 18th birthday.

Still, it is really important for you to find out what your status is, and since your status is closely tied to your mom's, I suggest you GENTLY bring this up. Ask your mom to have a look at HER Green Card, OR ask your mom to see YOUR passport, or ask your mom for YOUR Social Security Card.

I understand that might take a few days, but it's really important for you to do this now. Imagine you "just let go" of this, only to find out in a few years from now that you are in a position where you can't go to college and can't get a job and are basically stuck. NOW's the time to find a way for you, and I promise you, I'll help you to the best of my ability.

There's a lot of very knowledgeable people on this board. What we need to get started if trying to establish your current immigration status and your mom's.
