we fall under AWA, so it's not a surprise waiting this long, we just dont understand what's their basis of keeping on delaying the application and what kind of investigation are they doing that they can't decide yet considering it's been there for 2 years...did biometrics, submitted the noid docs, made rfe's , numerous calls and emails/letters..ALSO, we were informed our application was transferred to vermont to speed up the processing last may 2010, and yet they said it was DENIED last march 2010. why would they trasfer said application if it's already denied before the transfer? we are happy seeing others approved ahead of us, but at the same time we dont understand also what's their basis of calculating the POSE NO RISK thing...

Ok I am AWA and I was transferred to vermont as well, I think the person who said you were denied was confused or gave wrong information. You got an RFE, responded to the RFE and was transferred May of 2010 to vermont right? I was transferred July of 2010 to vermont after I responded to the RFE

Has your case been touched since? I get the same excuse " additional review which causes longer processing times"

well the journey of our k1 visa is over but we know this is just only the beginning of a far greater journey. Goodluck to all and thank-you to everyone for your support, advice and prayers. VJ is a great help really.. :thumbs:

Congratulations, I'm so happy for you guys, you guys and the other approvals are blazing the trail for the rest of us. We're supposed to have a decision in late Dec. This process is stressful enough and to add the AWA dimension just compounds it. I believe if couples can make it through this process they will be married for life. Good luck to you both, I wish you all the happiness in the world.

I am also AWA filer, new to VJ, to see others experience for this. After 8 months no reply I called my senator, staffer there told me AWA filers all sent to VSC for processing and all are in delay waiting for answers comming from current cases filed from denials??? No guarantee of accuracy for that.She told me it will be 3-6 months still for reply for my case? I was shocked "and a little bit sick" to see how long some of you here are waiting already. Good luck and god bless to everyone....

What do you mean "waiting for answers coming from current cases filed from denials"?

That 3-6 month time frame they tell you, they will tell you that over and over for about 2 years total it seems. Hopefully your case will be approved sooner but it hasn't happened for the rest of us =/

What do you mean "waiting for answers coming from current cases filed from denials"?

That 3-6 month time frame they tell you, they will tell you that over and over for about 2 years total it seems. Hopefully your case will be approved sooner but it hasn't happened for the rest of us =/

Like I said, I'm new and just starting to read more about others experience from AWA. It was my "impression" from senator staffer "not uscis staffer" that they are sorting AWA cases from past/current court rulings ie: what will be allowed, what not?? I think maybe it is just B.S.?? Seems to me every case will be different.

Maybe best I should just keep my mouth shut and keep reading??? You guys here seem much more experienced for this.....

Oh no problem, I just thought uscis directly told you something . They dont tell us much of anything . Its possible that they go by criminal case date, but some of us have been waiting a long time

Evli and Adam i have the feeling this year you will get approved too.....polygraph and new updated risk evaluation are a help too thats our 3rd and last evidences we submitted good they jst accepted it.

i am uncertain if I posted?

it is a lifeline for positive  assurances with others like I who are AWA.  We will be filing I129F soon my fiancé & I have been praying for a successful outcome, I am aware it is 50/50. Each case is based in its own merits it is up to USCIS discretion to approval we hope and pray to overcome our case. Everyone circumstances are different USCIS agent May your heart soften..

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
