Hello,

My wife recieved a 221g form after her interview for a dismissed case when she was in her teens. The Embassy stated to wait for them to contact her, however we read that a Letter of Explanation is needed from the NBI. Has anyone been through a similar situation before? About how long does it take for them to process or what steps do we need to do?

A little background regarding the case, it was filed by a family member due to a misunderstanding regarding lost jewelry but was quickly dismissed from the court system by the same family member that filed the case soon after it was filed.

It's horrible something that happened a decade ago and so menial has put a hold on her finally getting her visa. Hay, I miss my honey bear so much....

Am so sorry you guys are experiencing this. :(

When someone's NBI Certificate states No Criminal Record, the person in question (your fiancee) has to request from the NBI a letter explaining what the notation means, and your fiancee also has to produce documents showing that the charges were dismissed. She will need to contact NBI to find out what they need to help support that letter. From what I remember, it shouldn't take long to get it straightened out (I didn't undergo it, but know of several former clients who have).

02-23-2018: Date on NOA, retrieved from online account

02-23-2018: Date on Biometrics Appointment Letter (Biometrics Appointment at Jacksonville ASC on March 13, 10:00 a.m.)

03-08-2018: Biometrics complete

04-05-2018: Case status updated - Interview Scheduled on May 10, 2018, 10:15 a.m. :D

05-10-2018: Citizenship Interview - Passed English and Civics Tests, Recommended for Approval! :D 

06-19-2018: Received email and text notification: Naturalization Ceremony Scheduled; waited for letter to be uploaded on online account - it has been set on Wednesday, July 25, 3:00 p.m.

07-25-2018: I am now a U.S. Citizen!

Sorry to hear what you are going thru!

It is hard to believe that having the words NO CRIMINAL RECORD on your NBI report is not a GOOD thing.

I can not tell you about ALL situations but only give insight into our experiences!

What exactly does the 221G indicate?

Are any boxes checked telling YOU what you need to do???

If nothing is checked.......then USEM will initiate the communication with the NBI.

You can call USEM for updates (and to bug them) and to question them about what is happening with your process.

Your application is technically in administative processing until they receive the "Letter of Explanation" from the NBI.

After the USEM receives the explanation they will review it and make a decision so if you can provide supporting documentation ie: court documents

What USEM told us....they will mail a letter to the beneficiary telling him/her to take the 221G request to the NBI asking for a "Letter of Explanation" to be processed. Must be the official USEM request letter. NBI would NOT give us anything with reference to the NO CRIMINAL RECORD.

What the NBI will tell you once you give them the request.....THEY will send the results back to USEM. They will NOT give it to you.

The USEM will send someone to the NBI each week to pick up paperwork (this happens that often).

If the NBI does not have the court paperwork......it would be wise on your part go to the court and get the documentation!!!!

If you have the original dismissal paperwork (we did)...it could speed up the process (make copies and give to USEM.....do NOT give originals).

You MUST keep contacting the USEM for updates to keep them on top of it.

We had to involve our United States senator (sent emails requesting updates) to keep USEM processing in a timely manner!

USEM indicated they mailed a request for the "Letter of Explanation" to her.....but after 2 weeks we still hadn't received.

We called USEM and were told we could come to the Embassy and pick up a copy to take to NBI.

BTW....each person we spoke with at USEM had a different version of what we needed to do and what the timeline would be.

It took almost 6 weeks to resolve and receive our visa!!!!

This was part of our process in July 2010....

Hello, thanks for sharing your story with me, helps to ease the mind knowing that we can possibly have this resolved within a 6 week time frame.

The 221g only has a check box requiring a Letter of Explanation from the NBI

Luckily we have all of her Court documents available and a statement from her family member explaining the situation notarized by a lawyer for the NBI. We sent copies of all these docs when submitting the IV Package in hopes that this would be enough "Had read about the Letter of Explanation on several sites". I'll diffenetly be contacting USEM to check into having her just go to the Embassy directly to pick up the letter needed to get the NBI process moving along.

My father had this situation before. He went to NBI for additional background check and somebody did interview him. After that, NBI will send a letter to USEM, then USEM will review again your case for approval/denial. This took approximately about 2 weeks.

During the time we are processing....Manila has tropical depression (no electric for several days) and there are a couple holidays so USEM is not open.

Also waiting for the letter that never comes added 2 weeks delay.

BTW....when USEM received documentation....we did not go back for another interview....we had given them all of our documentation and explaination at the first interview....then simply waited (and called every few days) for visa approval!!!

We will be praying for you!!!!

My wife and I tried calling USEM today, "you weren't kidding about the mixed responses", first teller was nice but couldn't provide any good info, next one stated that my wife needs to go the NBI to make an inquiry about it but the last one I talked to stated that we just wait and do nothing until we hear from the Embassy. I can tell this will be a fun time for us...

Hello jgmes.....It would almost be funny if it weren't so sad!!!!

Ok....so our personal experience....

My asawa "knows" some people in NBI Manila.... :rofl:

Even so....NBI Manila (she went there 3 times) told her they could not do anything without having the official letter from USEM!

NBI Manila did not care about the 221G....they would only honor official USEM letter request.

It took almost 3 weeks...from interview...for USEM to send letter to us (which we never received).

After USEM told us we could pick up copy of letter...Ana took to NBI Manila same day and USEM picked up "Letter of Explanation" on Friday.

FYI...USEM told her to bring "Letter" back to USEM window 25......but NBI Manila said they would not give to her....must be picked up by USEM!!! :rolleyes:

I can not answer your last question (can it be processed by any NBI)....but I would guess it must go thru NBI Manila ? ? ? (only my thoughts)

If you can go to NBI.....I would try and see if they will accept 221G....will save you time if they do accept!!!!!

If we can help in any other way....please let us know!!!
