Hello,

My name is Carlos and this is my question:

I have finished my studies at Michigan State University and I already have a job in Naples, Florida but my F-1 visa with OPT expires in May. I am also engaged and my fiance, who is American, and I are planning our wedding in January. Since I have a job and I am also getting married, I was wondering which is the better option (faster and cheaper) for me to apply: the H1-B employment visa or the K-3 spouse visa.

I believe that uscis discontinued the K3 option. Even if you went that way it would take longer. I believe you might be able to file for I485 adjustment of status after getting married since you didn't enter the states with the intent to marry. Only question would be if you can leave the country at all between now an getting married. Also you might not be able to work after filing AOS without work authorization. Well, either option you would have had to file for aos, I'm just wondering if you might be able to skip the middle step.

visas are for people who are outside of the country. You are INSIDE the US so you do not need a visa. You may simply adjust status from an F-1 non-immigrant to a resident

YOU would not apply for an employment visa, your employer would petition for you.

I suggest getting married and petitioning for your adjustment of status
