hi guys, i need some advice..

i and my fiancee is getting married this february 2011 here in the philippines, I read from the website of US embassy in Manila about the process of obtaining a legal capacity to marry. and they said, its by appointment. My fiancee would like to have a reservation as early as now but the problem is february 2011 is still not available. my first question is, how soon should she do some reservation via the website?. and How long will it takes? can she get the documents the same day when she ask for it? ..

my second question is. she will only be staying here for 12 days. since i am a catholic, i would like a church wedding, but she is not a catholic. shes a lutherans, and i read the requirements for a church wedding and it says that she needs to have a consent coming from her parish that she will have the wedding to another parish.. though, shes not a catholic.

my third question is. My fiancee is 27 years old. does she needs to have a written consent coming from her parents for her to marry me?

my fourth question is. i am 23 years by time of our marriage. i read that I will be needing a parental advice. how will i be able to get a parental advice? i mean, my parents is supporting me for the marriage. the fact that they will contribute even to the expenses.lol.. do i still need to write a statement telling that they did advised me about marriage?lol.. i dont know what does it mean..

my fifth question is. how long is the approximate time for processing a church wedding? could it be possible that i will process everything here while shes in the states ? or do we need to both process everything? i read that they have some sort of seminars a month prior to the wedding, can we do a proxy on that? as she will not be able to come a month prior to the wedding, and it would be so expensive also on her part.

my sixth question is. if we plan to have a civil wedding, is there anyway to waived the 10 day waiting period? if there is, please let me know.

looking forward to all your help... thank u in advance...

My wife and I were married in the Catholic Church there in the Philippines in December.

As for the Legal Capacity to Marry, at that time the USEM did not require an appointment to issue it. It was first come, first served. I showed up there around 7:30AM and it took about 2 hours to get mine.

You should check with your parish about what their requirements are. We found a parish in Davao that had a half-day seminar designed for those marrying foreign spouses. I don't believe either of you need any parental consent because your both over 21 and your parish may not even require a letter from her church, but she should talk with her pastor and see if he would provide one anyway.

That 10 day wait from the time you request a marriage license until it's available to you may be a problem and you should check with your local office to see if there is anyway to get started before your fiance arrives.

Also, if you start now, you should have plenty of time to plan for a February wedding. If you can afford it, hire a wedding planner, they're great.

Best of luck!

Are you the beneficiary or the petitioner?

My husband is Presbyterian, and I am Catholic. We opted for a Christian ceremony instead of a civil one. It was almost like a church wedding with a minister, but not quite. :) I did the wedding arrangements myself, with the help of friends.

You will get the Legal Capacity to Marry document the same day as the appointment. Keep watching for when the appointments are available in February...since your fiance will only be there for 12 days (my husband was here for the same amount of time when we got married in the Philippines...it was a really tight schedule!)

Since you guys are getting married, you will not be applying for K1 anymore, right? Who needs the parental consent/advice? Certainly not USCIS or the Embassy. Was it the church asking for it? That left me kind of confused.

The 10-day waiting period, as the previous poster mentioned is standard. No way around that...and that refers to 10 business days...if there are any holidays in between the the time you applied for the marriage license up to the time it is issued, they will not be counted as part of the 10 days.

Try talking to the civil registry to see what you can get done in advance. I tried with ours (Paranaque) but they refused, they really want both of us there in person. Perhaps your local civil registry office will be more lenient.

i am the beneficiary ..

is it possible to have a civil wedding in the reception? i mean can we do the civil wedding not inside the mayors office or inside the court room and rather on the reception of our wedding?

thanks for telling me, atleast i would have an idea ahead of time on how things should run in the future..

we plan for IR1/CR1... as i think its faster and cheaper.. i know k1 is faster in terms of processing but knowing that when u get to to US, u still have to wait for 90 days before u can get a work permit, and other documents.. and k3 i think and as far as i have been doing my research is not necessary anymore since IR1/cr1 is as fast as k3 nowadays..

Who needs the parental consent/advice? Certainly not USCIS or the Embassy. Was it the church asking for it? That left me kind of confused.

i read it under the family code of the philippines..

thanks for the advice....i highly appreciate it.. thanks again..
