Hi everyone,

I really want to get through the embassy interview first time, so I want to have all of the documentation perfect! My question is, when do you require a co-sponsor for evidence of support? My fiancee is making over 125% of the poverty line, so does that mean that her sponsorship is enough?

09/14/06 - Moved to Boston on K1 Visa

10/27/06 - Married in Boston!

11/05/06 - Mailed AOD and EAD packages to Chicago

11/11/06 - NOA1

11/29/06 - I-485 sent to California SC for "faster processing"

12/07/06 - Email received: I-485 received and pending at California SC

01/25/07 - Another email saying my I-485 was transferred to CSC on 11/29/06.

02/08/07 - Biometrics taken

02/09/07 - Touch on EAD and AOS

02/14/07 - Email received: EAD Card production ordered

02/16/07 - Mailed application for Advance Parole to Chicago. Traveling 06/14. Could be close.

02/20/07 - EAD Card received! Time to start paying for my own drinks...

02/28/07 - Another touch on AOS.

02/28/07 - Another email saying my AOS case is pending at CSC. Hmmm.

04/06/07 - I-485 APPROVED! Welcome letter is in the mail.

Yes that is right, but remember they need to be able to prove that income by at three years past tax returns.

Visa Approved! Interview Completed.

Visa Delivered by DELBROS October 28th, 2006

October 30, 2006 Arrived back in LAX with Melinda, were going to Disneyland!!!

November 6th, 2006, Melinda and I are back home in Winslow Arizona loving Life!

I have a question?

What if we (the sponsor) only started working three years ago. For instance, I just hit my three-year anniversary of my job. That means I'd have two years of full tax returns and one half-year. Also, what if you cannot find past tax returns? I heard that paystubs and statements from your employer also work?

You dont need the affadvit of support which is required for the spouse visa. In k-1 you just submit I-134. In that case you may not need to have poverty line restriction. This poverty line requirment is for I-864 when you apply for AOS or K-3/souse visa.

Four visits to japan in 2004: Oct 2004, wife got pragnant.

Wife/Fiance left USA and moved into Japan: Feb 5th 2005.

Baby Born: June 24th 2005(Japan)

I-130 denied: July 17 2005(Divorce was declared not valid)

Refiling Divorce: oJuly 17th 2005 NY State.

Divorce granted: Nov 17th 2005

K-1 application: Mar 1st 2006

Approval: May 23rd 2006

US consulate RFE: June 15th 2006

FRE sent (Original passports, birth certificate, all origional docs): July 10th 2006

Medical: Oct 11th 2006.

Interview: Nov 10th 2006(expected)

Do the same income requirements apply to all immigrant visa applicants even if they use the I-134?

No. The 125 percent minimum income requirement, the need for the most recent year's tax return and other requirements only apply when an I-864 is needed. Applicants using the I-134 will need to show that their sponsor's income is 100 percent of federal poverty guidelines as required under Section 212(a)(4) of the INA.

Check with the consulate site or with others going through same consulate to see what they require. Some will require that the sponsor is 100% of the poverty guidelines, others 125%.

The I-134 is only one thing that a conof may use to determine if the applicant will or wont become a public charge. Hence why in many cases documentation and requirements outside of what is instructed with the I-134 is often needed eg tax returns. Consulates vary.

I came to USA on November 2005 after 19 years of absence, cause i was raised in other country where i met my fiancee. So my situation is kinda complicate with the affidavit, cause as you can imagine, i just started working on this year so i dont have any tax returns yet and even though i am making enough to meet the requirements of the poverty income, i dont know if will be able to sponsor her. And the interview will be on the third week of September.

Should i look for a co-sponsor? What do you guys think or know about it?
